HomeMy WebLinkAbout1962-0355 - Ordinance - 09/24/1962BOORUM & PEASE BOORUM & PEASE "Ni"��eN-Ft® ORDINANCE NO. 355 AN ORDINANCE TO PREVENT PERSONAL INJURIES TO SCHOOL CHILDREN BY REGULATING THE PASSING OF SCHOOL BUSES IN THE CITY OF COLLEGE STATION, PROVIDING A PENALTY FOR VIOLATIONS, AND DECLARING AN EMERGENCY. WHEREAS, it is provided in Article 6701d, Section 104, of the Civil Statutes of Texas, 1925, that the driver of a vehicle upon a highway outside of a city or town shall stop before passing a school bus which is in the process of discharging or receiving children, and WHEREAS, there is no similar regulation to protect children while such school buses are operating on the streets of College Station, and WHEREAS, it is desirable to protect school children when arriving at and departing from their homes to school on school buses, THEREFORE, BE IT ORDAINED by the City Council of the City of College Station, Texas: SECTION 1. The driver of a vehicle upon a street in the limits of the City of College Station upon meeting or overtaking, from either direction, any school bus which has stopped on the street for the purposes of receiving or discharging any school children shall stop the vehicle immediately before passing the school bus, but may then proceed past such school bus at a speed Which is prudent, not exceeding ten (10) miles per hour, and with due caution for the safety of the children. SECTION 2. Any person, violating this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction, be punished by a fine not exceeding fifty ($50.00) dollars. SECTION 3. The fact that schools have commenced in College Station, Texas, at the present time, and the further fact that there is no adequate safeguard in existence for the protection of school children entering and leaving buses on the streets of the City of College Station, creates an emergency and an urgent public necessity requiring that the rules and provisions providing for ordinances to be read more than one time at more than one meeting be suspended, and requiring that this ordinance be passed as and take effect as an emergency measure; such rules and provisions are accordingly suspended and this ordinance is passed and shall take effect as an emergency measure and shall be in full force and effect from and after its passage.
