KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS )
THAT, the Estate of W.M. SPARKS, Deceased, by and through CAROLYN
LUNDELIUS and BEVERLY BRALEY, its Administrators, GRANTORS, of
the County of Brazos, State of Texas, for and in consideration of
the payment of TEN and NO/100 DOLLARS, cash, and other good and
valuable consideration, in hand paid to GRANTORS by the CITY OF
COLLEGE STATION, TEXAS, the receipt of which is hereby acknowl-
edged, have GRANTED, SOLD and CONVEYED and by these presents do
GRANT, SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a
Texas Municipal Corporation, certain rights and interests in the
nature of a perpetual EASEMENT on and through the following
described property:
Being a strip of land twenty feet (20 ' ) wide for a
permanent public utility easement situated in the
Maria Kegans League, Abstract No. 28 , Brazos
County, Texas, of a 6.63 acre tract conveyed to
W.M. Sparks by deed recorded in Volume 376, Page
244, of the Deed Records of Brazos County, Texas.
Provided, however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and
centerline on the attached Exhibit "A", known as the "Easement
Area" , and any additional area outside the easement area neces-

sanitary sewer lines for which this easement is granted.
To erect, construct, install , and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify, and remove the
following:

lines, access facilities, and related equipment;
upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim
and control the growth of trees and other vegetation on and in
the easement area or on adjoining property of GRANTORS, which
might interfere with or threaten the operation and maintenance of
any public utility equipment, accessories, or operations. It is
understood and agreed that any and all equipment and facilitie
placed upon said property shall remain the s
property of GRANTEE.
GRANTORS expressly subordinate all rights of surface use incident
to the mineral estate to the above described uses of said surface
by GRANTEE, and agrees to sublender' s subordinations on behalf of
GRANTEE upon request.
It is expressly understood that the GRANTORS or future Owners of
this property reserve the right to use this EASEMENT for all
purposes which do not interfere with or prevent its use by the
GRANTEE.

person whomsoever lawfully claiming, or to claim same, or any
part thereof.

EXHIBIT "A"
W.M. SPARKS TRACT
Being a strip of land 20 feet wide for a permanent public utility
easement situated in the Maria Kegans League, Abstract No. 28,
Brazos County, Texas, of a 6.63 acre tract conveyed to W.M. Sparks
by deed recorded in Volume 376, Page 244 of the Deed Records of
Brazos County, Texas. The centerline of said 20-foot easement being
more fully described as follows:
Beginning at an iron pin on the southeast right-of-way line of
State Highway 30, said iron pin also being the most northwesterly
corner of said Sparks tract; Thence southeast 418.2 feet along the
southwest property line of said Sparks tract to the POINT OF BEGINNING:
THENCE N 45°14`30" E 426.5 feet to a point;
THENCE N 39°57'44" E 155.0 feet to a point on the common property
line of said Sparks tract and a 6.36 acre tract conveyed to M. Lawrence
Parker by deed recorded in Volume 376, Page 249 of the Deed Records of
Brazos County, Texas, and the end of this easement; said point also
being southeast 374.9 feet, more or less, along the common property
line of said Sparks and Parker tracts from an iron pin on the south-
east right-of-way line of State Highway 30.
An additional easement for construction purposes is granted for
one (1) year from the date hereon, said construction easement being
a 50-foot wide strip of land whose southeasterly boundary is coinci-
dent with the southeasterly boundary of the aforesaid 20-foot permanent
utility easement.
