KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS *
THAT, DAVID W. SCARMARDO, GREGORY SCARMARDO, MARK C.
SCARMARDO and PETE SCARMARDO GRANTORS of the County of Brazos,
State of Texas, for and in consideration of the payment of TEN
AND NO/100 DOLLARS, cash, and other good and valuable
consideration , in hand paid to GRANTOR(s ) by the City of College
Station , Texas, the receipt of which is hereby acknowledged,
HAVE GRANTED, SOLD, AND CONVEYED and by these present do GRANT,
SELL, and CONVEY unto the said City of College Station , a Texas
Municipal Corporation certain rights and interests in the nature
of an EASEMENT on and through the following described property:
Being situated in the Robert Stevenson League in Brazos
County, Texas and being a 12 . 934 acre tract of land conveyed
to David W. Scarmardo , Gregory Scarmardo , Mark C. Scarmardo ,
and Pete A. Scarmardo by Michael J. Muth et ux by deed
recorded in Volume 482 , Page 806 of the Deed Records of
Brazos County, Texas.
Provided however , that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course , width, and
centerline on the attached Exhibit "A" , known as the " Easement
Area" , and any additional area outside the easement area
necessary to install and attach anchors and guy lines or wires.
To erect, construct, install, and thereafter use, operate ,
inspect, repair , maintain , reconstruct, modify, and remove the
following:

Electric transmission and distribution lines
upon , over , and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim
and control the growth of trees and other vegetation on and in
the easement area or on adjoining property of Grantor , which
might interfere with or threaten the operation and maintenance of
any public utility equipment, accessories, or operations. It is
understood and agreed that any and all equipment, poles, and
facilities placed upon said property shall remain the property of
Grantee .
TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its succesors and
assigns forever , and GRANTOR(s ) DOES hereby bind themselves,
their successors and assigns to warrant and forever defend, all
and singular , these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming, or the claim same , or any
part thereof.

Being all that certain tract or parcel of land lying and being
situated in the Robert Stevenson League in Brazos County, Texas, and
being a part of that 12.934 acre tract of land conveyed to David W.
Scarmardo, Gregory Scarmardo, Mark C. Scarmardo, and Pete A.
Scarmardo by Michael J. Muth it ux by deed recorded in volume 482
page 806 of the Deed Records, Brazos County, Texas and being more
particularly described by the following centerline description.
The following is a centerline description of a twenty-foot (20' )
wide utility easement, said easement to be measured ten (10) feet in
width on eachsideof the following described centerline:
Commencing at a point located two (2) feet outside the easterly
corner of the property, said corner being in the northwesterly right-
of-way line of Rock Prairie County Road.
Thence along centerline S 450 W for a distance of 231 feet to the
- point of exit from said property, said point being located two (2)
feet outside the most southerly corner of the property, the same corner
being in the northwest right-of-way line of Rock Prairie County Road.
