HomeMy WebLinkAbout1988-1757 - Ordinance - 05/26/1988ORDINANCE NO. 1757 AN ORDINANCE AUTHORIZING A TAX ON THE CONDUCT OF BINGO GAMES. WHEREAS, the City of College Station received a petition to re- quire that an election be held to legalize bingo games under the Bingo Enabling Act, Article 179d of the Texas Revised Civil Stat- utes (the "Act"); and WHEREAS, a legalization election was held on May 7, 1988; and WHEREAS, a majority of the qualified voters voting in the legal- ization election voted in favor of legalization; and WHEREAS, the holding of bingo games as authorized by the Act is now legalized throughout the City of College Station; and WHEREAS, Section 3(b) of the Act authorizes a municipality that has voted to legalize bingo to impose a two percent (28) gross receipts tax on the conduct of bingo games within the municipal- ity; and WHEREAS, the City Council deems it appropriate to adopt this or- dinance. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COL- LEGE STATION, TEXAS, that: I. A two percent (2%) gross receipts tax is hereby imposed on the conduct of bingo games within the City of College Station. II. "Gross Receipts" means the total amount received from the sale, rental, transfer, or use of bingo cards and entrance fees charged at locations in which bingo is conducted, pursuant to the Bingo Enabling Act, Article 179d, Section 2(13). III. The tax hereby imposed is effective from the date of the signing of this ordinance. PASSED, ADOPTED and APPROVED this 26th day of May, 1988.
