HomeMy WebLinkAbout2015-3671 - Ordinance - 08/13/2015 ORDINANCE NO. 2015-3671 AN ORDINANCE AMENDING CHAPTER 12, "UNIFIED DEVELOPMENT ORDINANCE," SECTION 12-4.2, "OFFICIAL ZONING MAP," OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY CHANGING THE ZONING DISTRICT BOUNDARIES FOR APPROXIMATELY 20.872 ACRES FROM R RURAL TO 17.14 ACRES OF RS RESTRICTED SUBURBAN AND 3.732 ACRES OF SC SUBURBAN COMMERCIAL,BOTH TRACTS BEING LOCATED IN THE THOMAS CARUTHERS LEAGUE, ABSTRACT NO.9, COLLEGE STATION, BRAZOS COUNTY, TEXAS. SAID TRACTS BEING PORTIONS OF THE REMAINDER OF A CALLED 26.25 ACRE TRACT AS DESCRIBED BE A DEED TO DALE W. CONRAD AND WIFE, REBA J. CONRAD RECORDED IN VOLUME 460, PAGE 505 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS; GENERALLY LOCATED AT 4201 ROCK PRAIRIE ROAD, MORE GENERALLY LOCATED AT THE NORTHEAST CORNER OF ROCK PRAIRIE ROAD AND BIRD POND ROAD, PROVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That Chapter 12, "Unified Development Ordinance," Section 12-4.2, "Official Zoning Map,"of the Code of Ordinances of the City of College Station,Texas,be amended as set out in Exhibit "A" and Exhibit "B", and as shown graphically in Exhibit "C", attached hereto and made a part of this ordinance for all purposes. PART 2: That if any provisions of any section of this ordinance shall be held to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections of this ordinance, which shall remain in full force and effect. PART 3: That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dollars($25.00)nor more than Two Thousand Dollars ($2,000.00). Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. Said Ordinance, being a penal ordinance, becomes effective ten (10) days after its date of passage by the City Council, as provided by Section 35 of the Charter of the City of College Station. PASSED, ADOPTED and APPROVED this 13th day of August, 2015 ED: MAYOR ATTEST: J v�G City Secreta APPROVED: � ` ,� i Arr///,I 46_ City ' orney ORDINANCE NO. 2015-3671 Page 2 EXHIBIT "A" That Chapter 12, "Unified Development Ordinance," Section 12-4.2, "Official Zoning Map," of the Code of Ordinances of the City of College Station, Texas, is hereby amended as follows: The following property is rezoned from R Rural to RS Restricted Suburban, as shown graphically in EXHIBIT"C" and with the following conditions and/or restrictions: 1) Development of the subject property will be served by gravity sewer to a public sewer main only without the use of a lift station or force main, as proposed in an amendment to the rezoning application by the applicant of record. 2) A buffer will be provided along the eastern property line,beginning at the northeastern corner of the subject property and extending south along the rear of four (4) lots, at a length of approximately 335 feet. The buffer shall include an eight (8) foot fence on the property line and three (3) trees planted in the rear yard of each of the four(4) lots.
