HomeMy WebLinkAbout1971-0731 - Ordinance - 03/22/1971ORDINANCE NO, 731 AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF IMPROVING PORTIONS OF NIMITZ STREET AND MARSTELLER AVENUE IN THE CITY OF COLLEGE STATION, TEXAS, WITHIN THE LIMITS BELOW DEFINED, PERFORMED BY YOUNG BROS. CONTRACTORS, INC.; AUTHOR IZING AND DIRECTING THE ISSUANCE OF SPECIAL ASSESSMENT CERTIFICATES IN CONNECTION THEREWITH; DECLARING AN EMERGENCY; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY UPON ITS PASSAGE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: SECTION I. That the work of improving the following streets or portions thereof in the City of College Station, to -wit: All that certain portion of Marsteller Avenue described as follows: Commencing at the intersection of Marsteller Avenue and Francis Street; thence in a southeasterly direction along Marsteller Avenue until same intersects Woodland Parkway; and All that certain portion of Marsteller Avenue described as follows: Commencing at the intersection of Marsteller Avenue and East Woodland Parkway; thence in a southeasterly direction along Marsteller Avenue until same intersects Gilchrist Avenue; and All that certain portion of Nimitz Street described as follows: Commencing at the intersection of Nimitz Street and Cooner Street; thence in a northwesterly direction along Nimitz Street until same intersects University Drive; and by placing improvements to Mar- steller Avenue and Nimitz Street consisting of a six (6) inch compact depth limestone base with a one (1) inch asphalt plant mix with concrete curbs to a width, measured from back to back of 28 feet, as provided in said plans and specifications and the said work having been performed and completed in accordance with the provisions and terms of the contract and the plans and specifications therein contained dated July 16, 1968, between the City of College Station and Young Bros, Contractors, Inc. , the city engineer of the said City having measured, examined and caused to be tested the finished improvements by the means and in the manner provided by the terms of such contract and the plans and specifications therein contained, and the said city engineer having found that such improvements have been ®nstructed and completed in full compliance with such contract and the plans and specifications therein contained, and having approved and accepted said improvements and work and having heretofore issued his certificate of final acceptance, and having so certified to the City Council of the City of College Station, Texas, and having recommended that such City Council accept and receive said work and improvements as consLrucLed by said Young Bros. Contractors, Inc, , and the said work and improvements having been found by the Mayor and said City Council of the said City of College Station, to have been performed and completed in full compliance with the terms of said contract and plans and specifications, the same are hereby, now accepted and approved by the City Council of the City of College Station, Texas. SECTION II. That the Mayor and City Secretary of said City are hereby authorized and directed to issue to the City of College Station special assessment certificates evidencing the assessments against property improved abutting upon said streets within the limits above defined and against the real and true owner or owners thereof; said assessment certificates to be executed in the name of the City of College Station by the Mayor and City Secretary thereof and impressed with the seal of the City and dated as to the day thereof, and such officers are hereby authorized and directed to execute said certificates in their official capacities on behalf of said city and deliver same to the City of College Station, Texas. That it is necessary to immediately complete the improvements upon the hereinabove streets in said City and to complete the assessments levied for a portion of the cost of said improvements upon and against the properties abutting upon said streets and the owners thereof, creates a public emergency and this ordinance should be passed on this day and shall take effect as an emergency measure and be in full force from and after its passage and it is so ordained.
