BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: WHEREAS, an affidavit having been made by all of the owners of the hereinafter described territory adjoining the lImits of the City of College Station, Texas, to the effect that there are no registered voters residing within the boundaries of the hereinafter described territory and that the affiants are the sole owners of the hereinafter descrlbed territory, and WHEREAS, the aforesaid affidavit having been filed with the City Secretary who has certified the same to the Cxty Council, NOW, THEREFORE, the City Council by virtue of the authority conferred by Article II, Section 6 of the Charter of the City of College Station, Texas, ~ov~ h~~ ~ this ordinance does hereby rec c th the incorporated limits of the City of College Station, Texas, such territory being more particularly described as follows: TRACT P Being all that certaln 119.53 acre tract or parcel of land located in the Thomas Caruthers League, Brazos County, Texas, more particulary described by metes and bounds in the description attached hereto and marked Exhibit "B". Attached to and incorporated herein as a part of this Ordinance is a service plan, marked Exhibit "A", providing for the extension of municipal services into the duly described territory, said plan having been presented at the public hearing heretofore named and subsequently approved by the city council of the C~ty of College Station, Texas. APPROVED} / . / GARY H~LTEIt, ~YOR ATTEST: City Sectary Exhibit "A" SERVICE PLAN TO Whom It May Concern: This document addresses the extension of Municipal Services within a 119.53 acre tract located in the Thomas Caruthers League adjacent to and south of the current city limits and as described more fully in the ordinance of annexation. The City Council of the City of College Station, by action on October 13r 1983~nd prior to the passage of the ordinance of annexation of the above-named tract, did approve Resolution No. 10-13-83-04 , entitled A RESOLUTION ADOPTING A PLAN OF SERVICE FOR ANNEXATION OF 2580 ACRES ALONG STATE HIGHWAY 6 TO THE SOUTH OF THE CITY OF COLLEGE STATION, TEXAS. Said Resolution, duly recorded in the official MINUTES RECORDS of the City of College Station and available for viewing in the office of the City Secretary, provides for the extension of municipal services into this area, as prescribed by the provisions of Article 970a, Vernon's Texas C~vil Statutes, as amended by HB-19b2. Section 1. of RESOLUTION NO. 10-13-83-04 plan for providing the following services: presents a a. Police b. Fire c. Emergency medical d. Water e. Sewers f. Electrical g. Refuse collection h. Streets i. Inspection j. Planning and zoning k. S~reet lighting 1. Recreation m. Miscellaneous (street name signs) RESOLUTION NO. ]0-13-83-04 explains the extension plan and provides complete information relating to each of the above-named municipal services. ATTACHMENT ~,O~, "Tract LEGAL DESCI~IPTION All that certain tract or parcel of land lying and being situated in the Thomas Caruthers League in Brazos County, Texas, hein~ all of Tracts I and 2 shown on plat of Dymple Carl1 Crea$or Tract recorded in Volume 335, Page 131 of the Deed Records of Brazos County, Texas, and Being more particularly described aa follows: Beginning at · cop4rete mon--~nt found in the southwest line of Rock Prairie Road at the most Easterly corner of that 120.3 acre tract conveyed to Braxton S. Thompson by deed recorded in Volume 367, Page 263 of the Deed Records of Brazoa County, Texas. Thence S 41 degrees 55' 18" W - 2208.92 feet along the southeast line of the said Thompson tract to an iron pipe found at the cvs=on corner of Tracts 1 and 4 of the said Dymple Creagor Tract; Thence S 48 degrees 16' 32" E - 3513.77 feet along the line between the sa~d Tracts 1 and 4 and Tracts 2 and 3 of the said Dymple Creagor Tract to an iron -1pa at the c~on corner of Tracts 2 and 3 in the southeast line of the Thomas ~aruthers League; Thence N 41 degrees 55' 52" E - 1425.20 feet along the southeast 11ne of the said Tract 2 to a 3/8" iron rod found marking the south corner of the 120 acre tract conveyed to Dolly Olden by deed recorded in Vol,m~ 168, Page 339 of the Deed Records of Brazos County, Texas; Thence N 48 degrees 05* 46," W - 3297.29 feet along the line be=ween the said Olden tract and the said Tract 2 to a wood post marking the west corner of the said Olden tract; Thence N 41 de8rees 53* 47" E - 886.11 feet along the northwest line of the said 01den tract to a wood post in the southwest line of Reck Prairie Road; Thence N 75 degrees 457 52'* W - 244.28 feet along the southwest line of Reck Prairie Read to the Point of Beginning and containing 119.53 acres of land more or lass, EXHIBIT B
