HomeMy WebLinkAbout1983-1426 - Ordinance - 06/09/1983ORDINANCE NO. 1426 AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 850, REVISING DEFINITIONS OF AND REAR SETBACKS FOR ACCESSORY USES, STRUCTURES OR BUILDINGS. WHEREAS, the City Council held a public hearing in the City Hall at 7:00 P.M. on Thursday, June 9, 1983, on the question of amending the Zoning Ordinance No. 850; AND WHEREAS, the City Council has determined to amend Ordinance No. 850; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: The Zoning Ordinance No. 850 is hereby amended as follows: 1-D.1. ACCESSORY USE OR STRUCTURE OR BUILOING: A building, structure, or use which (1) is subordinate to and serves a principal building or use; (2) ~s subordinate in area, extent, or purpose to the principal use served; (3) contributes to the comfort, convenience, or necessity of occupants of the principal use served; (4) is located within the same zoning dlstrlct as the principal use; (5) in residentlal districts is not used for commercial purposes and Js not rented or occupied by persons other than bona fide servants employed on the premises and members of the family of the occupant(s) of the primary structure. Examples of accessory buildings, structures, or uses ~nclude, but are not llmited to, private garages, greenhouses, living quarters for family or servants, tool sheds or bath houses. Persons are related within the meanJn? of th~s section ~f they are related with the second degree of consanguinity or affinity. THE DIS';rlCT USE SCHEDULE - TABLE A is amended as shown attached with note "1" added as follows: "A minimum rear setback of 15 feet is required for accessory buildings or structures located on lots where approved rear access is provided. Setbacks shall be measured from the nearest boundary of the access easement or public alley." Thls ordinance shall become effective ten (10) days after the date of approval and publication.
