AN ORDINANCE AMENDING CHAPTER I, SECTION 13 OF THE CODE OF ORDI-
NANCES, CITY OF COLLEGE STATION, TEXAS, PROVIDING FOR ESTABLISH-
MENTS HOLDING A LATE HOURS PERMIT FOR THE SALE OF MIXED BEVERAGES
OR BEER AND WINE TO REMAIN OPEN AND SERVE SUCH BEVERAGES UNTIL
1:00 A.M. ON JANUARY 1 OF EACH YEAR W~EN SUCH DAY FALLS ON A
WEEKDAYw AND PROVIDING FOR POSSESSION AND CONSUMPTION OF ALCOHOL-
IC BEVERAGES IN PUBLIC PLACES UNTIL 1:00 A.M. ON JANUARY 1 OF
EACH YEAR WHEN SUCH DAY FALLS ON A WEEKDAY.
HE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STA-
TION, TEXAS,
That Chapter I, Section 13B and Section 13C of the Code of Ordi-
nances of the City of College Station, Texas, is hereby amended
to read as follows:
"B. CONSUMPTION AND POSSESSION OF ALCOHOLIC BEVERAGES
It shall be unlawful for any person in the City of Col-
lege Station, Texas, to consume any alcoholic beverage
in any public place or for any person to possess any al-
coholic beverage in any public place for the purpose of
consuming the same in such public place at any time on
Saturday between the hours of 1:15 a.m. and 7:00 a.m.;
on Sunday between the hours of 1:15 a.m. and 12:00 noon;
and on the other days of the week between the hours of
12:15 a.m. and 7:00 a.m. (except January first of each
year as provided in Section 13B[2]).
It shall be unlawful for any person in the City of Col-
lege Station, Texas, to consume any alcoholic beverage
in any public place or for any person to possess any al-
coholic beverage in any public place for the purpose of
consuming the same in such public place at any time on
January first of each year between the hours of 1:00
a.m. and 7:00 a.m. when such day falls on a weekday.

of the week between the hours of 12:15 a.m. and 7:00
a.m. (except January first of each year as provided in
Section 13C[2]).
Notwithstanding provisions herein to the contrary, any
establishment holding a mixed beverage license or an
on-premises beer and wine license and also allowed to
operate pursuant to a late hours permit issued by the
Texas Alcoholic Beverage Commission, may operate said
establishment and serve permitted beverages until 1:00
a.m. on January first of each year when such day falls
on a weekday."
II.
THAT THIS ORDINANCE IS HEREBY PASSED IN ACCORDANCE WITH SECTIONS
105.03 THROUGH 105.05 OF THE ALCOHOLIC BEVERAGE CODE AND UNDER
THE HOME RULE POWERS GRANTED TO THE CITY UNDER THE CONSTITUTION
AND LAWS OF THE STATE OF TEXAS.
