AN ORDINANCE ADDING SECTION ? TO CHAPTER ? OF THE CODE OF ORDI-
NANCES OF THE CITY OF COLLEGE STATION, TEXAS, PROHIBITING RETAIL
SALES OF UNPASTEURIZED MILK AND MILK PRODUCTS WITHIN THE CITY
LIMITS OF COLLEGE STATION.
WHEREAS, Article 165-3, Vernon's Annotated Texas Civil Statutes,
has been amended to pre-empt cities from regulating the sale and
production of milk and milk products except in the manner as
specified in that Article; and
WHEREAS, Article 165-3, Section 4(d), Vernon's Annotated Texas
Civil Statutes, as amended, allows cities to continue to prohibit
the sale at retail of unpasteurized milk and milk products;
NOw, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION, TEX~q:
That Chapter 7 of the Code of Ordinances of the City of College
Station, Texas, is hereby amended by adding a new Section, to be
numbered Section 7, which said section shall read as follows:
"SECTION 7: SALE OF UNPASTEURIZED MILK OR MILK PRODUCTS
PROHIBITED."
The retail sale or offer for sale of milk or a milk product
which is not Grade "A" pasteurized as defined by State law
is prohibited.
Proof of the sale or offer for sale of milk or a milk prod-
uct without a Grade "A" pasteurized label on the container
in which it was sold shall constitute prima facie evidence
that the milk or milk product was not Grade "A" pasteurized.
A person who violates any of the provisions of this sec-
tion is subject to a fine of not less than Twenty Dollars
($20.00) and no more than One Thousand Dollars ($1,000), as
provided for in Article 4.14 of the Texas Code of Criminal
Procedure.
II.
This section shall be and become effective from and after its
passage in accordance with the City Charter of the City of
College Station.
