HomeMy WebLinkAbout1985-1573 - Ordinance - 02/14/1985ORDINANCE NO. 1573 AN ORDINANCE VACATING AND ABANDONING A PORTION OF A SANITARY SEW- ER LINE EASEMENT CONVEYED TO THE CITY OF COLLEGE STATION, TEXAS, HY VICTORIA KAPCHINSKI, SITUATED IN THE MORGAN RECTOR LEAGUE, AB- STRACT NO. 46, AS RECORDED IN VOLUME 335, PAGE 461 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS, AND BEING PRESENTLY SITUATED IN A {5.0 ACRE TRACT OF LAND CONVEYED TO RONALD E. HOLMES AND WIFE LAURA BY DEED RECORDED IN VOLUME 617, PAGE 65] OF THE DEED REC- ORDS OF BRAZOS COUNTY, TEXAS, AND BEING MORE PARTICULARLY DE- SCRIBED ON EXHIBIT "A" ATTACHED HERETO. WHEREAS, on January ], 1974, Victoria Kapchinski conveyed to the City of College Station a sanitary sewer line easement across property later conveyed to Ronald E. Holmes and wife Laura, de- scribed in the attached Exhibit "A"; and WHEREAS, the City of College Station changed the direction of the sanitary sewer line, thus abandoning the portion of the easement described in the attached Exhibit "A" and instead placed the line on the property as described in the attached Exhibit "B" and are adding to that line as described in the attached Exhibit "C"; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF COLLEGE STATION, TEXAS: For and in consideration of the conveyance of the easements across the property described in the attached Exhibits "B" and "C," the City Council of the City of College Station hereby authorizes the Mayor and City Secretary to abandon the easement across the property described in the attached Exhibit "A." HOLMES TRACT Being a 20-foot wide sanitary sewer 1/ne easement to be deleted, said easement being the western portion of a 20-foot w/de strip of land for a sanitary sewer 1/ne easement conveyed to the City of College Station, Texas, by Victoria Kapchinski as recorded in Volume 335, Page 461 of the Deed Records of Brazos County, Texas, situated in the Morgan Rector League, Abstract No. 46, Brazos County, Texas; said portion of easement to be deleted also being presently situated in a 15.0 acre tract of land conveyed to Ronald E. Holmes and wife Laura by deed recorded in Volume 617, Page 653 of the Deed Records of Brazos County, Texas; the centerltne of said 20-foot easement to be deleted being more fully described as follows: Commencing at the south corner of a I0.0 acre tract of land conveyed to Frank J. Matous, Jr. and wife Helen by Victoria Kapchinski as recorded in Volume 261, Page 629 of the Deed Records of Brazos County, Texas; Thence in a northwesterly direction a distance of 18.6 feet, more or less, co a point, said point also being the POINT OF BEGINNING of the aforesaid existing 20-foot sanitary sewer line easement; Thence S 42a59' W 541.5 feet, more or less, across the following properties to an angle point; A 3.0 acre tract of land conveyed to Henry Kapchinski and wife Joyce by Victoria Kapchinski as recorded in Volume 332, Page 41 of the Deed Records of Brazos County, Texas; The remaining portion of a 12.91 acre tract of land conveyed to Henry Kapchinskt and wife Joyce by Victoria Kapchinskt as recorded in Volume 343, Page 284 of the Deed Records of Brazos County, Texas; A 15.0 acre tract of land conveyed to Ronald E.
