April 12, 1945
Members present: Mayor E. Langford; Councilmen J. A. Orr,
G. B. Wilcox, M. T. Harrington, and E. E. Brown; and Lloyd
D. Smith, City Manager.
Visitors present: J. G. Gay, Lloyd Heaton, Fred Jensen,
A. Mitchell, D. B. Cofer, E. B. Reynolds, Frank Anderson,
Rev. Norman Anderson, S. W. Bilsing, and L. S. Paine.
On motion by councilmen Orr, second by councilmen Wilcox, the
following letter was approved as the answer of the City Council
to the trustees of the A. & M. Presbyterian Church:

Gentlemen:
The City Council has taken considerable time since the public
hearing on your request of December 12, 1944, to investigate all of
the restrictions and limitations set forth in the deeds of the property
owners in the Oakwood Addition of the City of College Station. We
find that certain positive and definite restrictions are included in
all deeds and we quote as follows:
Sec. 2. "Lots 6 to 11 inclusive in Block 1 of said Oakwood
Addition shall be used for residential purposes only ...."
Sec. 9. "The above and foregoing restrictions, stipulations and
conditions shall be effective until January 1, 1948; but
at any time with two years of said date, the then owners
of a majority of the square-foot area of the lots in said
Addition may, on the basis of one vote for each square
foot owned, by majority vote, extend, renew, change, amend,
or abolish these restrictions and conditions, as they may
wish; provided that such meeting shall be held at the
principal offices of the Oakwood Realty Company of College
Station."

We also quote from Section 17 of Ordinance No. 38, entitled
Zoning Ordinances
and where the provision of such easements, covenants
or laws impose greater restrictions upon the use of buildings
or premises, such provision of such easements, covenants
or laws shall not be interfered with by any of the pro- -
visions of this ordinance."
The Council accepts the restrictions set forth in the deeds to
property owners of the Oakwood Addition as covenants entered into
between themselves and the realtors. They further aooept these
covenants as imposing greater restrictions in the Oakwood Addition
than does the Zoning Ordinance. In view of these facts the Council
has no alternative other than to deny the petition.
It is further ordered by the Council that a copy of this
action be published in the Battalion at the earliest possible date.
Passed and approved by the City Council of College Station,
Texas, April 12, 1945.

Mr. Smith was instructed to handle the question of the alley back
of the residence of Mrs. D. Scoates to the best of his judgment
and was assured that the Council would accept whatever solution he
might approve.
