HomeMy WebLinkAbout1988-1750 - Ordinance - 05/26/1988ORDINANCE NO. 1750 AN ORDINANCE CLOSING THE PUBLIC HEARING AND DECLARING THE NECES- SITY FOR THE CONSTRUCTION OF A PORTION OF FIDELITY STREET IN THE CITY OF COLLEGE STATION, PROVIDING THAT THE ABUTTING PROPERTY OWNERS ON SAID PORTION SO CONSTRUCTED BE ASSESSED A SHARE OF THE EXPENSE, PROVIDING FOR A PUBLIC HEARING, AND PROVIDING A SAVING CLAUSE IN THE EFFECTIVE DATE. WHEREAS, the City Council hereby declares the necessity for the construction of a portion of Fidelity Street in the City of College Station, Texas, by raising, grading, filling the same, installing concrete curbs and gutters, paving, sidewalks and in- stalling drains, inlets and storm sewers as provided in the plans, with necessary incidentals and appurtenances, at the loca- tion described as follows: that portion of Fidelity Street from Fairview Street to Wellborn Road, all as is shown on the plat attached hereto as Exhibit A. NOW, THEREFORE, be it ordained by the City Council of the City of College Station: That the abutting property owners listed in the attached Exhibit B have petitioned for the improvement of the street and that the petition has been certified by the City Secretary. That the property owners of the abutting property on said portion of said street to be improved and constructed be assessed a proportionate cost of said improvements of the maximum total cost of Forty -Seven Thousand Fifteen Dollars and Eighty -Three Cents ($47,015.83) assessable under the ordinance, same to be on a per linear foot basis for curb and gutter, sidewalks and pav- ing. The cost of the curb, sidewalks and gutter shall be borne by the property owners and the cost of the paving to be shared by the property owners and the City in proportion provided by law. Notice shall be given by advertisement inserted at least three (3) times in a newspaper published in the City as required by Article 1105-b of the Texas Revised Civil Statutes of a public hearing to be had on the ordinance providing for such improve- ments to be made and assessing property owners and fixing a lien against the abutting property to cover the cost of said improve- ments. II. A hearing was held by and before the governing body of the City of College Station on the 26th day of May, 1988, at 7:00 P.M., at the City Council Chambers of the City of College Sta- tion. Testimony, recommendations and objections were considered at such hearing. The hearing is hereby closed. 005274 This ordinance shall be cumulative of all ordinances in the City of College Station, Texas; and in the event of any conflict with any prior ordinance, the terms and provisions of this ordinance shall be controlling. IV. This ordinance shall become effective and be in full force and effect from and after its passage and approval by the City Council and duly attested by the Mayor and City Secretary.
