AN ORDINANCE VACATING AND ABANDONING A PORTION OF A UTILITY EASE-
MENT, TWO FEET (2') IN WIDTH BY 214.87 FEET IN LENGTH, LOCATED ON
LOT 50 OF BLOCK 65 OF THE SOUTHWOOD FOREST SUBDIVISION, COLLEGE
STATION, BRAZOS COUNTY, TEXAS, ADJACENT TO LOT 49 OF BLOCK 65 OF
THE SOUTHWOOD FOREST SUBDIVISION, FOR AND IN CONSIDERATION OF THE
RECEIPT OF A TWO FOOT (2') WIDE BY 214.87 FOOT LENGTH OF EASE-
MENT, WHICH EASEMENT IS ADDED TO THE TEN FOOT (10') WIDE EASEMENT
LOCATED ON LOT 49 OF BLOCK 65 OF THE SOUTHWOOD FOREST SUBDIVI-
SION.
WHEREAS, Maria Scorro Vargas filed an application and request
with the City Council of the City of College Station that a por-
tion of the ten foot (10') easement located on Lot 50 of Block
65 of the Southwood Forest Subdivision, adjacent to Lot 49 of
Block 65 of the Southwood Forest Subdivision, be abandoned; and
WHEREAS, the City Council found that the house constructed on Lot
49 had encroached by 1.2 feet into the dedicated public utility
easement; and
WHEREAS, the City of College Station received a request from W.D.
Fitch to take additional easement from Lot 49 by two feet (2') in
width and 214.87 feet in length; and
WHEREAS, for and in consideration of the vacating therefor, the
City Council accepts the additional two feet (2') in width and
214.87 feet in length of easement on Lot 49 of Block 65 of the
Southwood Forest Subdivision.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that:
I.
Pursuant to the application and request of both Maria Scorro
Vargas and W.D. Fitch on behalf of Area Progress Corporation,
Inc., that the portion of the two foot (2') width of the utility
easement that is encroached by the structure constructed on Lot
50 of Block 65 of the Southwood Forest Subdivision is hereby
abandoned and vacated upon execution of an easement for an addi-
tional two feet (2') in width by 214.87 feet in length on Lot 49
of Block 65 of the Southwood Forest Subdivision that is an ease-
ment for twelve feet (12') in width on Lot 49 of Block 65 of the
Southwood Forest Subdivision, College Station, Brazos County,
Texas.

II.
The Mayor is hereby authorized to hold the ordinance and execute
it upon acceptance by the City Attorney of an easement as de-
scribed herein.
