HomeMy WebLinkAbout1990-1853 - Ordinance - 07/26/1990ORDINANCE NO. ~ AN OHDINANCE REZONING THREE (3) TRACTS OF LAND TOTALLING 23.039 ACHES LYING AND BEING SITUATED IN THE WOODCREEK SUBDIVISION IN COLLEGE STATION, BRAZOS COUNTY, TEXAS AND BEING MORE PANTICULARLY DESCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE FROM A-O AGRICULTURAL OPEN (ONE (1) TRACT CONSISTING OF 15.769 ACRES OF LAND) AND R-3 TOWNHOUSES (TWO (2) LAKE TRACTS TOTALLING 7.27 ACRES) TO R-1 SINGLE FAMILY RESIDENTIAL. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: WHEREAS, the City Council has determined the following: To rezone or change the classification of the following three (3) tracts of land lying and being situated in the Woodcreek Subdivision in College Station, Brazos County, Texas and being more fully described by metes and bounds as follows: TRACT NO. Being a 15.769 acres tract or parcel of land lying and being situated in the Morgan Rector League, Abstract No. 46, College Station, Bra2os County, Texas, and being part of a 112.86 acres tract conveyed by Warranty Deed to the East By- Pass Development Group on July 16, 1979, and recorded in Volume 428, Page 297, of the Deed Records of Brazos County, Texas, and being the southeasterly portion of that part of said 112.86 acres tract lying in the said Morgan Rector League~ said 15.769 acres tract being more particularly described as follows: BEGINNING at a sandstone monument (lying in the common line of the Thomas Carruthers League, Abstract No. 9, and the said Morgan Rector league) marking the beginning point of a 11.30 acres tract called Tract One in the Deed recorded in Volume 1157, Page 194, of the Deed Records of Brazos County, Texas, said monument also marking a ins/de #ell' corner of the said 112.86 acres tract. THENCE S 44 degrees 47' Il' W along the said common league line marking the northwest line of the said Tract One for a distance of 1128.70 feet to an iron rod found for corner~ THENCE N 29 degrees 26' 57' W for a distance of 457.20 feet to a Iron rod set for the west corner of e herein described 15.769 acres tract~ THENCE N 44 degrees 47'11" E for a distance of 1498.72 feet to a Iron rod set for corner In a fence line marking a southwesterly line of the now or formerly Letbetter 125.9 acres tractI THENCE S 45 degrees 17' 03" E along the said fence line marking the southwesterly line of the 125.9 acres tract and also the 6.58 acres City Park Tract (formerly Tract F recorded In Volume 918, Page 678, of the Deed Records of Brazos County, Texas) for a distance of 440.00 feet to a Iron rod set for corner In the said common league line, said set Iron rod marking the north corner of the 4.32 acres lake Tract H recorded In Volume 918, Page 678, of the Deed Records of Bra2os County, Texas~ THENCE S 44 degrees 47' 11" W along said common league line passing at a distance of 225.58 feet a Iron rod found marking the north corner of the said 11.30 acres tract continuing for a total distance of 494.78 feet to the PLACE OF BEGINNING containing 15.769 acres of land more or less, from A-O Agricultural Open to R-1 Single Family Residential. TRACT NO. 2 Being a 2.95 acres tract or parcel of land lying and being situated In the Thomas Carruthers Survey, Abstract No. 9, Brazos County, Texas, and being called Lake Tract "G," as described In the Deed (executed on September 30, 1986, and recorded In Volume 918, Page 678, of the Deed Records of Brazos County, Texas) said Tract G conveyed to E. W. Schultz, Trustee, for Cornerstone Investment Group, a Texas Joint venture, said Tract G being more particularly described as follows; COMMENCING at the northwest corner of Block I, Woodcreek Section One, as recorded by plat in Volume 529, Page 23, of the Deed of Records of Brazos County, Texas and lying In the south right-of-way line of Woodcreek Drlve~ THENCE S 80 degrees 25' Il" W for a distance of 408.59 feet with said right-of-way line to the PLACE OF BEGINNING. THENCE S 07 degrees 18' 45" W for a distance of 188.21 feet to a point for angle polnt~ THENCE S 33 degrees 27' 10" W for a distance of 115.31 feet to a point for corner~ THENCE S 39 degrees 05' 03" E for a distance of 76.24 feet to a point for corner; THENCE S 51 degrees 44' 05" W for a distance of 57.40 feet to a point for corner; THENCE 9 17 degrees 01' 32" E for a distance of 144.71 feet to a point for corner~ THENCE S 82 degrees 36' 00" W for a distance of 223.69 feet with said southern line to a point for corner. Said point lying in the southeast right-of-way line of Woodcreek Drive. Said point being the beginning of curve to the right. THENCE in a northeasterly direction along the arc of said curve, having a central angle of 23 degrees 25' 01#, a radius of 587.95, the chord bears N 68 degrees 42' 40" E for a distance of 238.85 feet to a point for end of said curve. THENCE N 80 degrees 25' 11" E for a distance of 163.52 feet to the PLACE OF BEGINNING, and containing 2.95 acres of land, more or less, from R-3 Townhouses to R-1 Single Family Residential. TRACT NO. 3 Being a 4.32 acres tract or parcel of land lying and being situated in the Thomas Carruthers Survey, Abstract No. 9, Brazos County Texas, and being called Lake Tract 'H", as described in the Deed (executed on September 30, 1986 and recorded in volume 918, Page 678, of the Deed Records of Brazos County, Texas), conveyed said Tract "H# co E.
