HomeMy WebLinkAbout1991-1893 - Ordinance - 05/08/1991ORDINANCE NO. 1893 AN ORDINANCE AMENDING CHAPTER 7 OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS BY THE RENUMBERING OF SECTION 8(H) (1) (b) AS SECTION 8(H) (1) (b) (i), REGULATING THE ISSUANCE OF PERMITS FOR THE OPERATION OF RETAIL FOOD STORES, AND BY THE ADDITION OF SECTION 8(N)(1)(b)(ii), PERMITTING THE CHARGING OF A LATE FEE FOR RETAIL FOOD STORE PERMIT RENEWAL APPLICATIONS NOT RECEIVED BY FEBRUARy i OF THE YEAR FOR WHICH THE PERMIT IS SOUGHT, AMD PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION: That Chapter 7 of the Code of Ordinances, City of College Station, Texas, is hereby amended by renumbering Section 8(H) (1)(b) as Section 8(H)(1)(b)(i), and adding a section, to be numbered Section 5, Subsection H(1)(b)(ii), which said section shall read as follows: "H. COMPLIANCE PROCEDURES (1) Permits. Licenses. or Certificate~ (ii) The application for a renewal permit and the accompanying fee must be received by the Health Department on or before February I of the calendar year for which the permit is sought. If such application and fee are not received by the date herein specified, the Health Department may charge the retail food store up to an additional 20% of the fee due and owing as a late penalty for failure to comply with the requirements of subsection (a), above. The charging of such late fee will have no effect on the City's right to seek criminal penalties permitted by the enforcement provision of this ordinance.,, Ordinance No. 1893 Page 2 II. And, it is ordained that this ordinance shall become effective from and after its passage in accordance with the City Charter of the City of College Station.
