HomeMy WebLinkAbout1990-1864 - Ordinance - 10/11/1990ORDINANCE NO. 1864 AN ORDINANCE AMENDING CHAPTER 1, OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION BY ADDING A SECTION 29 RELATING TO THE CEMETERY RULES AND REGULATIONS, AND SETTING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of College Station having met in its regular session on the 11th day of October, 1990, and WHEREAS, the City Council received a report from the Cemetery Committee making recommendations pertaining to cemetery rules and regulations NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION THAT: Chapter 1 of the Code of Ordinances of the City of College Station is hereby amended by adding a Section 29 relating to cemetery rules and regulations to read as follows: "SECTION 29: COLLEGE STATION CEMETERY RULES AND REGULATIONS A. GENERAL (1) The College Station Cemetery is set apart for the burial of the residents of this community subject only to the rules, ordinances, or laws of the City of College Station, the County of Brazos, and the State of Texas. (.2) The cemetery area, of approximately eighteen (18) acres, is divided into sections, with bounding streets and property lines. Ail sections are further divided into lots, each lot accessible by one or more paths or streets, or both. Lots are normally 20 feet by 20 feet, so platted as to permit division into an arrangement from one to eight spaces. (See Purchase options below.) (3) The City establishes all grades, terraces all lots, and keeps all areas generally smooth and level. B. ADMINISTRATION All administrative matters pertaining to the operation of the cemetery shall be under the direction of the City Manager or his delegate. The City Council further Ordinance No. 1864 authorizes the City Manager to designate a representative of the staff to act on his behalf. RULES ENFORCEMENT The City Manager or his delegate shall determine that the specifications and dimensions of each monument, headstone and/or marker proposed for the College Station Cemetery, fall within the scope of the approved regulations. No monument, headstone, and/or marker may be set in the cemetery unless approval has first been obtained from the City Manager or his delegate. (2) Ail monuments, headstones, and markers will require a permit approved by the. City Manager or his delevate before placement in the cemetery. .All permit requests must include appropriate drawings and dimensions for each requested marker. Permit request may be obtained from the City Secretary's office or the Cemetery Sexton's office. Any stone set in any way contrary to the regulations of this cemetery shall be subject to removal by the City of College Station; and replacement of same shall be the responsibility of the property owner after all regulations and procedures have been met and replacement has been approved by the Sexton or his agent. (3) Any requests for variances in these rules and regulations must be presented to the Cemetery Committee. Appeals from decisions of the Cemetery Committee shall be to the City Council. Appeals must be in writing and submitted to the office of the City Secretary within 10 days of the Committee's decision. The City Secretary's office shall schedule a hearing of the appeal before the Council within 30 days from receipt of the letter of appeal. OPEN HOURS The Cemetery shall be open Monday through Saturday from 8:00 AM to sundown, and Sunday from 6:00 AM to sundown. PURCHASE OPTI NS (1) Standard Plot: A purchaser may either choose a burial plot measuring five feet by ten feet, herein referred to as a "space," or a plot measuring twenty feet by twenty feet, herein referred to as a "lot." Two cremates will be allowed in a single space. Combinations of casket burials and cremates in a single space are not allowed. RESALE OPTIONS Separation or division of lots for resale by the purchaser is prohibited. All unwanted lot spaces may be returned to the City for remuneration at the original price of these spaces. PERPETUAL CARE (1) The sale of lots includes Perpetual Care Service, specifically the grading of roads, the maintenance and mowing of all lots, the general policing of the grounds, the control of any insect or animal that may cause damage, the free use of available water, and such other maintenance and control work as may be necessary to keep the cemetery presentable at all times. (2) Perpetual Care does not include the purchase, erection, repair, or replacing of any object which may have an authorized place on a lot. PLANTINGS (1) The planting of grass, flowers, shrubs, trees, or other type of vegetation shall be made only by or at the direction of the City. Such plantings at the discretion of the purchaser are prohibited and will be removed in accordance with the Rules Infractions Procedures. (2) An option available to property owners is a Memorial Fund. Money from this fund would be used for plantings within the cemetery according to an established landscaping plan. Planting and maintenance will be the responsibility of the City. Ordinance No. 1864 Je ARTIFICIAL FLOWERS No artificial flowers will be permitted in, on, or around lots or graves. If any are found, they will be removed by the City. COPINGS, HEDGES. FENCES, ETC. (1) No copings, hedges, fences, exposed vaults, walls, or other enclosures will be permitted in, on, or around any lots or graves. If any are found, they will be removed in accordance with the Rules Infraction Procedures. (2) Coverings and ledgers will only be permitted upon the approval .of th~ Cemetery Committee. For the purpose of this ordinance, a covering will be any material other than turf that may be placed over the grave, a ledger is any stone, monument, or marker that may be placed in such a way as to cover the grave space. MONUMENTS, HEADSTONES, AND MARKERS (1) Monuments, headstones, and markers shall be of such design, size, material, finish, and location as may be approved by the City Council. (2) Generally, family or double monuments (one per family in a plot containing at least 100 square feet) will be approved, provided that such monuments shall not exceed (including the base) 30 inches in height and 48 inches in length. The base shall not exceed 72 inches in length and shall not be higher than 6 inches above ground level. The back of an approved monument shall be flush with the rear lot line and equidistant from the side boundaries, and the monument shall be located on undisturbed ground. (3) Single grave markers shall not exceed 36 inches in length and 30 inches in height (including the base); the base shall not be more than 48 inches in length and shall not exceed 6 inches above ground level. No more than one single grave marker shall be permitted per space. (4) Monuments for single baby spaces (20 square feet) shall not exceed 15 inches in length and 22 inches in height (including the base); the base shall not be more than 21 inches in length and shall not exceed 6 inches above the ground. Monuments for - 4 - r~r Ordinance No. 1864 more than one space in the baby area (40 square feet or larger placed side by side) shall not exceed 30 inches in length and 22 inches (including the base) in height; the base shall not be more than 48 inches in length and shall not exceed 6 inches above the ground. (5) Vases or ornaments of any type shall be affixed to the base, shall not extend beyond the base, and shall not exceed the height of the marker. (6) Foot markers shall not exceed 12 inches in width and 24 inches in length. Corner markers shall not exceed 8 inches by 8 inches and must be set flush with the ground level. MAUSOLEUMS Mausoleums will be permitted only in Sections F, G, M, and J (section J is currently not open). The locations, size, and design must be approved by the City Council. RECORDS Records giving full data on all interments shall be kept in the City files, and shall be open to authorized persons. The data are to include the section, lot, and grave location, and the name, age, and the date of interment of each grave occupant. RULE INFRACTION PROCEDURES (1) In the event that the City Manager or his delegate determines that there has been an infraction of the rules, the City Manager or his delegate shall follow the procedures listed below. (2) Any existing plantings, copings, or fences that become unsightly or unkept (that exist before the adoption of this ordinance) shall be removed by the City Manager or his delegate using the following procedures. (a) Record and document infractions of the ordinance. (b) Notify owners and/or family members of the infractions along with options available for correction by registered mail. Ordinance No. 1864 (c) Allow 45 days for compliance or appeal to the Cemetery Committee. (d) Remove the items that constitute the infraction." II. This ordinance shall become effective and be in full force and effect from and after its passage and approval by the City Council and duly attested by the Mayor and City Secretary.
