HomeMy WebLinkAbout1994-2071 - Ordinance - 06/23/1994ORDINANCE NO 2071 AN ORDINANCE VACATING AND ABANDONING A PORTION OF A FORTY FOOT WIDE DRAINAGE EASEMENT, WHICH CROSSES AND LIES WITHIN LOT 7, BLOCK 1, EMERALD FOREST PHASE II (MORE COMMONLY KNOWN AS 8603 ROSEWOOD DRIVE), IN THE CITY OF COLLEGE STATION, TEXAS. WHEREAS, the City of College Station, has received an Appllceben for the Abandonment of a portion of a drainage easement, which crosses and hes within Lot 7, Block 1, Emerald Forest Phase II, more commonly known as 8603 Rose- wood Drive, in the ,CRy of Collage Station, said portion of the drainage easement being more particularly described on Exhibit "A" attached hereto; and WHEREAS on June 23, 1994, the City Council of the City of College Station, Texas, heard the apphcatlon of Emil E Ogden on behalf of the Ogden Living Trust for the vacation and abandonment of the aforementioned portion of the forty foot wide drainage easement that crosses and lies within Lot 7, Block 1, Emerald Forest Phase II, according to the plat recorded in Volume 453, Page 905, of the Deed Records of Brazos County, Texas, NOW, THEREFORE, be it ordained by the C~ty Councd of the City of College Station, Texas, that a portIon of a forty foot w~de strip of land previously platted as a drainage easement, which crosses and lies within Lot 7, Block 1, Emerald Forest Phase II, more commonly known as 8603 Rosewood Dr, ve in the CRy of College Station, as descrIbed on Exhibit "A" attached hereto, be abandoned and vacated; that the Mayor and the C~ty Secretary be authorized to convey by quit claim deed on behalf of the C~ty of College Station any right or claim that the CIty has in and to said portion of sa~d forty foot w~de strip of land to the Ogden L~wng Trust PASSED, ADOPTED and APPROVED th~s 23rd day of June, 1994 ATTEST. ~ Connie Hooks, City Secretary APPROVED EXHIBIT "A" GALINDO ENGINEERS AND PLANNERS 3833 South Texas Ave., Suite 280 Bryan, Texas 77802 (409) 846-8868 METES AND BOUNDS DESCRIPTION 1,254-SQUARE FEET TRACT PART OF A 40"-WIDE DRAINAGE EASEMENT Lot 7, Block One Emerald Forest Phase Two College Station, Texas Being a 1,254-square feet or pan=el of land and being a part of Lot 7, Block One, Emerald Forest Phase Two, an addition to the City of College Station, Texas, according to the plat recorded in Volume 453, Page 905, Deed Records, Brezos County, Texas, and said 1,254- square feet tract being more particularly described as follows: Commencing at a 1/2' iron rod found marking the southeastemmost comer of said Lot 7, said rod also marking the northernmost comer of adjoining Lot 8, Block One, said subdivision, THENCE S 84°16'47' W, along the common boundary between sa~d Lots 7 and 8 for a THENCE N 01054'57, E, along the existing west line of a 40'-wide drainage easement platted and recorded in Volume 453, Page 905, Deed Records, Brezos County, Texas, and which traverses said Lot 7, for a distance of 5.04' to the POINT OF BEGINNING; THENCE N 01054'57' E, continuing along sa,d west line of said easement for a distance of 103.33'; THENCE N 79056'24' E, along a line 5' south of and parallel to the common boundary hne between Lots 7 and 6, Block One of the referenced subdiwsion, for a d~stance of 14.77'; THENCE through Lot 7 along the following calls: S 18°19'47.
