HomeMy WebLinkAbout1994-2066 - Ordinance - 05/26/1994ORDINANCE NO. 2066 AN ORDINANCE REZONING A 3 325 ACRE TRACT OF LAND SITUATED IN THE ROBERT STEVENSON LEAGUE, ABSTRACT NO. 54, BRAZOS COUNTY, TEXAS, AND BEING A PART OF THE 20.999 ACRE TRACT CONVEYED FROM IVAN OLSON, TRUSTEE, TO FIRST AMERICAN BANK, AS DESCRIBED BY DEED RECORDED IN VOLUME 1552, PAGE 40, OF THE OFFICIAL RECORDS OF BRAZOS COUNTY, TEXAS, FROM A-O AGRICULTURAL TO C-1 COMMERCIAL WHEREAS, on May 26, 1994, the C~ty Council of the City of College Station convened and pursuant to notices proscribed by law held a public hearing with regard to the application for the rezoning of 3 325 acres of property situated in the Robert Stevenson League, Abstract No. 54, Brazos County, Texas, and more particularly described as follows: Being a 3 325 acre tract or parcel of land out of and a part of that certain 20.999 acm tract or land lying and being s~tuated in the Robert Stevenson League, Abstract No 54, Brazos County, Texas, said 20 999 acre tract being all that same 21 01 acre tract conveyed from Ivan Olson, Trustee, to F~rst Amedcan Bank, as described by deed recorded in Volume 1552, Page 40, of the Official Records of Brazos County, Texas, sa~d 3.325 acrs tract being more particularly described as follows BEGINNING at a 112" iron rod mari(~ng the east comer of said 21 01 acrs tract, the north comer of the rsma~nder of a called 22 79 acrs tract conveyed from Joseph S. Osoba, et ux, to C. Payton Waller, as desodbed by deed rscorded in Volume 327, Page 90 of the Deed Records of Brazos County, Texas, and lying In the southwest nght-of-way line of Texas State Highway No 6 THENCE, S 51° 21' 00" W - 402.64 feet with the southeast hne of said 21 01 acre tract to a point for comer THENCE, N 34° 17' 03" W - 388.05 feet through the interior of said 21 01 acre tract to a point for comer in the southeast line of that same 35.85 acre tract conveyed from Bob J Gnffin, et ux, to Lick Crsek, Ltd, as described by deed recorded In Volume 813, Page 555 of the Official Records of Brazos County, Texas. THENCE, N 55° 24' 57" E - 383 08 feet ruth the southeast line of said 35.85 acre tract to a 1/2" iron rod for comer in said Highway 6 nght-of-wey line, a Texas Department of Transportaben (Tex DOT) concrete right-of-way monument bears N 31' 15" 42" W THENCE, S 31° 15' 42" E - 102.39 feet w~th sa~d nght-of-wey line to a Tex DOT concrete right-of-way monument for angle point THENCE, $ 39° 34' 15" E - 258 25 feet w~th said right-of-way line to the PLACE OF BEGINNING, and containing 3 325 acres of land WHEREAS, the owner of the above-described property, Neatherhn Homes, Inc, (~furchased the property by deed recorded ~n Volume 1552, Page 40, of the icial Records of Brazos County, Texas, WHEREAS, the above-described property ~s currently zoned A-O Agr,cultural and the current use ,s agricultural, Ordtnance No. 2066 Page 2 WHEREAS the owner has appl,ed for the rezomng of the property to C-1 Commercial zoning; WHEREAS, the City Council of the City of College Station, Texas, heard evidence as to the location of this property on the west side of State Highway 6 South, approximately 1800 feet south of Graham Road; WHEREAS, evidence was presented that the area of south College Station is developing and that this property is located on the frontage road of a high traffic highway; and WHEREAS, the City Council of the City of College Station, Texas has encouraged the development of south College Station and had concluded that the development taking place in that area is a changed condition that makes the property more suited to commercial use, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the above-described property is hereby rezoned from A-O Agricultural to C-1 Commercial, effective immediately.
