HomeMy WebLinkAbout2010-3226 - Ordinance - 01/28/2010GRDINANCE NG. 20~o-322b AN GRDINANCE REPEALING THE CITY GF COLLEGE STATIGN BIKEWAY AND PEDESTRIAN MASTER PLAN DATED GCTGBER 2002 AND NETWGRK GF GREENWAYS FDR COLLEGE STATION DATED MAY 1999, AMENDING THE OFFICIAL CITY GF COLLEGE STATIGN CGMPREHENSIVE PLAN GRDINANCE 3186 AND ADGPTING THE BICYCLE, PEDESTRIAN, AND GREENWAYS MASTER PLAN AS SET GUT BELGW; PRGVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; A]VD PRGVIDING AN EFFECTIVE DATE. BE IT GRDAINED BY THE CITY CGUNCIL GF THE CITY GF COLLEGE STATIGN, TEXAS : PART 1: That Part 1 of Grdinance 3186 adopting the "Gfficial City of College Station Comprehensive Plan" as adopted on May 28, 2009 shall remain in full force and effect. PART 2: That the College Station Bikeway and Pedestrian Master Plan dated Gctober 2002 and Network of Greenways for College Station dated May 1999, adopted by the Gfficial City of College Station Comprehensive Plan, adopted by Grdinance 31 S6, May 2009, are hereby repealed. PART 3: That a new "Bicycle, Pedestrian, and Greenways Master Plan" as set out in Exhibit "A" and made a part of this ordinance for all purposes, is hereby adopted and approved. PART 4: That if any provisions of any section of this ordinance shall be held to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections of this ordinance, which shall remain in full force and effect. PART 5: That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dollars ~$Z5.00) nor more than Two Thousand Dollars ~$2,000.00~. Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. Said Grdinance, being a penal ordinance, becomes effective ten ~ 10} days after its date of passage by the City Council, as provided by Section 35 of the Charter of the City of College Station. ORDINANCE N0. 2010-326 Page 2 PASSED, ADOPTED and APPROVED this 28th day of , ZO10, ATTEST: APPROVED: City Secretary MAYOR APPROVED: City Attorn ORDINANCE NO. zolo-326 Page 3 E~I~IBIT "A" The City of College Station's Comprehensive Plan consists of the "Official City of College Station Comprehensive Plan" as set out in Part 1, and the following documents that have been approved in Part 3 and previously approved and are adopted by this ordinance: • Bicycle, Pedestrian, and Greenways Master Plan as set out in Part 3 • The Northgate Redevelopment Plan dated November 1996 • The Revised wolf Pen Creek Master Plan dated 1995 • Northgate Redevelopment Implementation Plan dated July 2003 • East College Station Transportation Study dated May 2005 • Parks, Recreation and Open Space Master Plan dated May 2005 • Park Land Dedication Neighborhood Park hones Map dated January 2009 • Park Land Dedication Community Park Zones Map dated April 2009 All other documents previously adopted as part of the Comprehensive Plan are repealed and superseded by the adoption of this ordinance. The Comprehensive Plan is to be used as a guide for growth and development for the entire City and its extra-territorial jurisdiction tETJ~. The Comprehensive Plan depicts generalized locations of proposed future land-uses, thoroughfares, bikeways, pedestrian ways, parks and greenways that are subject to modification by the City to fit local conditions and budget constraints, The Comprehensive Plan, in particular the Future Land Use Plan map, and any adopted , amendments thereto, shall not be nor considered a zoning map, shall not constitute zoning regulations or establish zoning boundaries and shall not be site or parcel specific but shall be used to illustrate generalized locations. The Comprehensive Plan, Thoroughfare Plan, and "Bicycle, Pedestrian, and Crreenways Master Plan", and any adopted amendments thereto, shall depict generalized locations of future thoroughfares, bikeways, greenways, and pedestrian ways that are subject to modifications by the City to fit local conditions, budget constraints, and right-of-way availability that warrant furtiher refinement as development occurs. Bikeways, greenways, thoroughfares and pedestrian ways ORDINANCE N~. 2010-3226 Page 4 may be relocated by the City l,ooo feet from the locations set in the plan or map without requiring a plan amendment. Any subsequent plans or studies amending the Comprehensive Plan shall be adopted by ordinance and shall become part of the Official City of College Station Comprehensive Plan,
