HomeMy WebLinkAbout1972-0832 - Ordinance - 08/28/1972ORDINANCE NO. 832 AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF SPRUCE STREET, 1r SUFFOLK AVENUE, PATRICIA STREET, LUTHER STREET, MONTCLAIR AVENUE AND BURT STREET IN THE CITY OF COLLEGE STATION, TEXAS, WITHIN THE LIMITS BELOW DEFINED, PERFORMED BY YOUNG BROTHERS, INC., CONTRACTORS; AUTHORIZING AND DIRECTING THE ISSUANCE OF SPECIAL ASSESSMENT CERTIFI- CATES IN CONNECTION THEREWITH; DECLARING AN EMERGENCY; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE UPON ITS PASSAGE BE IT ORDAINED by the City Council of the City of College Station, Texas: SECTION I. That the work of improving the following_ streets or portions thereof in the City of College Station, to wit: All that certain portion of Spruce Street described as follows: Commencing at the intersection of Spruce Street and Boyett Street, thence in a north- easterly direction along Spruce Street until same intersects College Main N. ; and All that certain portion of Suffolk Avenue described as follows: Commencing at the intersection of Suffolk Avenue and Pershing Avenue, thence in a southeasterly direction along Suffolk Avenue until same intersects Park Place; and All that certain portion of Patricia Street described as follows: Commencing at the intersection of Patricia Street and First Street, thence in a north- easterly direction along Patricia Street until same intersects College Main N.; and All that certain portion of Luther Street described as follows: Commencing at the intersection of Luther Street and FM 2154, thence in a northeasterly direction along Luther Street until same intersects Highland Street; and All that certain portion of Montclair Avenue described as follows: Commencing at the intersection of Montclair Avenue and Luther Street, thence in a southeasterly direction along Montclair Avenue until same terminates in a cul -de -sac; and All that certain portion of Burt Street described as follows: Commencing at the intersection of Burt Street and Pershing Avenue, thence in a southwesterly direction along Burt Street until same intersects Suffolk Avenue; by placing improvements to Spruce Street, Suffolk Avenue, Patricia Street, Luther Street, Montclair Avenue and Burt Street consisting of six (6) inch compacted depth of flexible base, as specified by the City Engineer, with a one (1) plant mix surfacing, or four (4) inch black base and one (1) inch plant mix surfacing; as provided in said plans and specifications and the said work having been performed and completed in ac- cordance with the provisions and terms of the contract and the plans and specifications therein contained dated March 24, 1971, between the City of College Station and Young Brothers, Inc. , Contractors, the city engineer of said City having measured, examined and caused to be tested the finished improvements by the means and in the manner provided Ordinance No. 832 Page 2 j by the terms of such contract and the plans and specifications therein contained, and the said city engineer having found that such improvements have been constructed and com- pleted in full compliance with such contract and the plans and specifications therein contained, and having approved and accepted said improvements and work and having heretofore issued his certificate of final acceptance, and having so certified to the City Council of the City of College Station, Texas, and having recommended that such City Council accept and receive said work and improvements as constructed by Young Brothers, Inc., Contractors, and the said work and improvements having been found by the Mayor and said City Council of the City of College Station, to have been performed and completed in full compliance with the terms of said contract and plans and specifications, the same are hereby, now accepted and approved by the City Council of the City of College Station, Texas. SECTION II. That the Mayor and City Secretary of the said City are hereby authorized and directed to issue to the City of College Station special assessment certificates evi- dencing and assessments against property improved abutting upon said streets within the limits above defined and against the real and true owner or owners thereof; said assessment certificates to be executed in the name of the City of College Station by the Mayor and City Secretary thereof and impressed with the seal of the City and dated as to the day thereof, and such officers are hereby authorized and directed to execute said certificates in their official capacities on behalf of said City and deliver same to the City of College Station, Texas. SECTION III. That it is necessary to immediately complete the improvements upon the hereinabove streets in said City and to complete the assessments levied for a portion of the cost of said improvements upon and against the properties abutting upon said streets and the owners thereof, creates a public emergency and this ordinance should be passed on this day and shall take effect as an emergency measure and be in full force from and after its passage and it is so ordained.
