HomeMy WebLinkAbout04/15/1980 - Regular Minutes - Zoning Board of Adjustmentsr • MTNUres ZONTNG BOARD OF ADJUSTMENT Apri 1 15 , 1980 7:00 P.M. • • PRESENT: Chairman Harper, Members Wagner, Upham, Daughety, Council Liason Boughton, Building Official Koehler Agenda Item No. 1 - Approval of Minutes, Meeting of March 18, 1980 - Boughton moved that the minutes be approved as presented. The motion was seconded by Wagner and unanimously approved. Agenda Item No. 2 - Consideration of a request fora Variance in the name of J.A. Spannagel, 1201 Merry Oaks Drive - Koehler pointed out that the applicant cited no unique or unusual circumstances and that setbacks were observed by existing structures throughout the neighborhood. Upham said that he had observed no unusual condition and that there would be a sight distance problem when Carol Street was extended. Harper said that there might be an alternative conforming location and that the owner should be able to discuss this point. In the absence of unique or special conditions not now shown, the Board could not grant a variance. Upham moved that the request be tabled until the next meeting. The motion was seconded by Boughton and unanimously approved. Agenda Item No. 3 - Consideration of a request fora Variance in the name of J.E. Kuder, Jr., 1020 Puryear - Koehler introduced a plat showing the setback line and a petition of support from near neighbors. He said that the sixty foot right-of- way was not normal fora residential street but that most houses along the street complied with the setback. He pointed out that up to six feet of overhang of front or rear setback was allowed by the ordinance. Upham remarked that all other structures along the street observed the setback and that the character of the neighborhood was as sig- nificant a factor as the amount of space behind the curb. Harper added that one of the intents of the ordinance is to achieve a degree of uniformity within neighborhoods and that the interests of future owners and neighbors is to be considered. • Minutes Apri 1 15 , 1980 Page 2 Harper moved that a variance be granted to the minimum setback requirement allowing a twelve foot encrochment in that it would not be contrary to the public interest and owing to unique and special conditions of the land a strict application of the ordinance would result in unecessary hardship. The motion was seconded by Upham and the note was as follows: For: None The Chairman declared the motion lost. Agenda Ttem No. 4 - Adjourn - There being no other business the meeting was declared adjourned. • •
