MEMBERS PRESENT: Chairman Henry, Vice Chairman Baker, Members Lane and Yarbrough, and Alternate Member DeOtte. MEMBERS ABSENT: Member Cronan, and Alternate Members Gaston, Webb, Phinney, and Kennady. STAFF PRESENT: Assistant City Attorney Coates, Planning Assistant Kuenzel, and Planning Technician Thomas. AGENDA ITEM NO. 1: Call to Order - explanation of functions and limitations of the Board. Chairman Henry called the meeting to order and explained the functions and limitations of the Board. AGENDA ITEM NO. 2: Approval of Minutes - Meeting of January 15, 1991 • Ms. Yarbrough moved to approve the minutes of meeting of January 15, 1991 as submitted. Mr. Lane seconded the motion which carried unanimously (5-0). AGENDA ITEM NO. 3: Consideration of a special exception request to allow the expansion of a non-conforming use which involves the increase in number of residential units, but not a change in the square footage of the building located at 1026 Foster. Applicant is Sidney A. Parker. Planning Assistant Kuenzel presented the staff report to allow the addition of an efficiency unit to a two story fourplex. The parking area is non-conforming in that it is not striped, paved, or curbed. All parking areas in the City must meet general parking standards. Lack of a formal parking layout makes it difficult to determine the amount of parking that is actually provided; however approximately 11 parking spaces could be placed in the gravel area towards the front of the property. Other non-conformities of the property include a parking structure in the rear two feet from the rear property line currently being used as a storage shed. The Zoning Board has the authority to allow an addition of this nature if it finds: -- The addition is necessary and incidental to the existing use of the building. -- The area of the building will not be increased more than twenty five percent. -- The addition will not prolong the life of the non- • conforming use or prevent a return of such property to a conforming use. Chairman Henry swore in applicant Sidney A. Parker as he addressed the Board. He explained that he wanted to renovate an area currently used for storage into an efficiency unit for the purpose of additional income. He informed the Board that many of the students occupying the residence do not have vehicles; however, there is plenty of parking space in the gravel area located at the front of the property. Mr. Parker stated that the entire lot will be re-landscaped upon completion of remodeling and eventually the rear storage area will be returned to a garage. Mr. Henry agreed that adequate parking was available to accommodate the addition of one dwelling unit. The addition is not necessary but it is incidental and existing; the applicant is utilizing the area to its fullest capacity by creating a living unit. Mr. Lane said that the addition meets all three conditions outlined by staff; however, the addition should upgrade the area. The addition is beneficial to the applicant but detrimental to the neighborhood. Ms. Baker moved to authorize the enlargement of a building devoted to a non-conforming use where such enlargement is necessary and incidental to the existing use of such building and does not increase the area of the building devoted to a non-conforming use more than 25% • and does not prolong the life of the non-conforming use or prevent a return of such property to a conforming use. Ms. Yarbrough seconded the motion which passed 4 - 1. Mr. Lane voted against the granting of a special exception. AGENDA ITEM NO. 4: Other business. There was no other business. AGENDA ITEM NO. 5: Adjourn. Ms. Baker moved to adjourn the meeting of the Zoning Board of Adjustments. Ms. Yarbrough seconded the motion which passed unopposed.
