MEMBERS PRESENT: Acting Chairman Gentry, Members Thompson & Henry, Alternate Members Baker 8 Garrett; Council Liaison Birdwell MEMBERS ABSENT: Chairman Ruesink & Member Gilmore STAFF PRESENT: Planning Assistant Johnson, Assistant City Attorney Banks and Planning Technician Volk AGBNDA ITEM N0. 1: Gall to order - explanation of functions and liaitations of the Board. Acting Chairman Gentry called the meeting to order and explained the functions and limitations of the Board. AGBNDA ITEM N0. 2: Approval of ainutes - aeeting of March 21, 1989. Mrs. Baker made a motion to agprove the minutes as submitted. Mr. Henry seconded the motion which carried unanimously {5-0). • AGENDA ITEM NO. 3: Hear visitors. No one spoke. AGENDA ITEM N0. 4: Consideration of a request for a variance to setback and height regulations of a satellite dish antenna to be located at the LaQuinta Motel at 607 Texas Avenue. Applicant is Coasat Video Enterprises. Mrs. Johnson gave a slide presentation while making the staff report, during which she identified the applicant, the property owner, the request and purpose of the request, area zoning and land uses, and described the physical characteristics of the subject lot. She explained that the required setback to the rear would be 15 feet and the proposed setback is approximately 4 feet. She also explained that the maximum height allowed for a satellite dish when it is located within 100 feet of a residential lot is 12 feet above grade, and the proposed height of this dish will be approximately 14 feet, so a variance to the height of the antenna as well as to the rear setback will be required for the applicant to continue with his proposed project. She pointed out that a similar variance request had been granted by the Board in 1986 for a satellite antenna dish of approximately 20 feet in height at the Hampton Inn. Mrs. Johnson then stated that the Fire Marshal had ruled that the dish cannot be located within any fire lane, and the proposal will not encroach into a fire lane, that 9 area property owner had received notification of this request and none had responded, and that the proposed antenna will be located in very close proximity to the existing sign for the Grapevine Restaurant (on the adjacent property), and will actually be of a lesser height than that sign. Mr. Thompson had questions about the ownership of the restaurant on the subject property and the configuration of the lot which Mrs. Johnson answered. Mr. Birdwell asked if the proposed height of this antenna would require a variance if it was not going to be located within 100 feet of a residence, and Mrs. Johnson said that it would not, and added that the antenna is going to be 80 feet from the residential property. Mr. Birdwell stated that if it were another 20 feet away, it would not need a variance and Mrs. Johnson clarified that it would not need a variance to the height regulations, but it would still need one for the rear setback requirements. Mrs. Johnson then pointed out that the residence which is within 100 feet of this proposed location actually appears to house a small home occupation, at least according to the small sign located on the building on the lot. After brief discussion by the Board, the applicant was invited forward to present his request. Mario Controni of Gettysburg, Maryland who is an employee of Comsat Video Enterprises came forward and was sworn in. He stated that the reasons for the variance to the height regulations for this antenna is due to the existing technology which now requires a certain height to receive a specific band. He stated that in the near future, he anticipates smaller antenna will be able to receive the band and the additional height will not be required. - After more brief discussion with Mr. Controni regarding the technical abilities of this antenna and the various angles which will be required for proper receiving, Mr. Birdwell made a motion to authorize a variance to the maximum height and minimum setback (for this antenna} from the terms of this ordinance as it will not be contrary to the public interest, due to the following special conditions: There is no place on the site where all conditions of the ordinance can be satisfied, and because a strict enforcement of the provisions of the ordinance would result in unnecessary hardship to this applicant being: (that he) could not use a dish large enough to obtain picture quality desired, and such that the spirit of this ordinance shall be observed and substantial justice done subject to the following limitations: Maximum dish to be 5 meters and not to exceed 20 feet in height. Dish to be within a fenced area. Motion seconded by Brett Henry. Discussion followed as to whether or not the motion should be amended to address other residential areas and the decision was made that it should not be amended. The original motion carried unanimously (5-0). AGENDA ITBM N0. 5: Other business. The only other business was the announcement by staff that there will not be a meeting on April 21, 1989. AGENDA ITEM NO. 6: Adjourn. Mr. Thompson made a motion to adjourn. Mrs. Baker seconded the motion which carried unanimously.
