SPECIAL WORKSHOP
June 3, 1986
5:00 P.M.
ZONING BOARD OF ADJUSTMENT MEMBERS PRESENT: Chairman Meyer
(late), Members McGuirk, Gilmore, Julian, Ruesink, Evans, Swoboda
STAFF PRBSBNT: City Attorney Locke, Zoning Official Kee,
Director of Planning Mayo, Assistant City Attorney Elmore and
Planning Technician Volk.
City Attorney Cathy Locke opened the informal meeting, handed out
several articles including the Conflict of Interest Statement, a
ZBA synopsis and several articles covering case law which might
be helpful to members in the future. She then addressed the term
"special condition" explaining that there really is no legal
guidance she can offer other than to use common sense and reason,
adding that in addition to simply being a special condition to be
considered, the granting of a variance must sot be injurious to
• the public interest, and if the variance is not granted, the
result would be unnecessary hardship to the applicant; this
hardship cannot be a self-created economic hardship.
After general discussion of what might constitute a "special
condition", Mrs. Locke advised each member to not hesitate to
seek her help if they have additional questions. Briefly other
subjects were discussed, afterwhich the meeting was adjourned.
