HomeMy WebLinkAbout2005-2816 - Ordinance - 07/28/2005 ORDINANCE NO. 2816 AN ORDINANCE AMENDING CHAPTER 9, "SUBDIVISIONS", OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY AMENDING CERTAIN SECTIONS AS SET OUT BELOW; PROVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: PART 2: PART 3: That Chapter 9, "Subdivisions", of the Code of Ordinances of the City of College Station, Texas, be amended as set out in Exhibit "A", attached hereto and made a part of this ordinance for all purposes. That if any provisions of any section of this ordinance shall be held to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections of this ordinance, which shall remain in full force and effect. That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty Five Dollars ($25.00) nor more than Two Thousand Dollars ($2,000.00). Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. Said Ordinance, being a penal ordinance, becomes effective on November 1, 2005, as provided by Section 34 of the Charter of the City of College Station. APPROVED: City Attorney 01 grouplle gall ord i nancel ame ndme ntf 0 rm. doc ORDINANCE NO. 2816 Page 2 EXHIBIT "A" That Chapter 9, "Subdivisions", of the Code of Ordinances of the City of College Station, Texas, is hereby amended as follows: 1. By amending SECTION 8: "General Requirements and Minimum Standards of Design" by deleting the current paragraph 8-F "Standards", and adding a new paragraph 8-F "Standards" to read as follows. "All construction on streets, alleys, or easements shall be designed and constructed in accordance with the Bryan/College Station Unified Design Guidelines and the Bryan/College Station Unified Technical Specifications and all applicable state and federal requirements. Where there is a conflict of standards, the more stringent standard as determined by the City Manager, or his designee, shall apply. The City shall accept for public use only streets, alleys, water and sewer main extensions that comply with these standards for construction." 2. By amending SECTION 8: "General Requirements and Minimum Standards of Design" by deleting the current paragraph 8-G.10 "Geometric Standards, Street Design Criteria", and Table 1 "Street Design Criteria" and adding a new paragraph 8-G.10 "Geometric Standards, Street Design Criteria" to read as follows. "Design criteria for urban and rural streets and alleys are contained in the Bryan/College Station Unified Design Guidelines and the Bryan/College Station Unified Technical Specifications." 3. By amending SECTION 8: "General Requirements and Minimum Standards of Design" by deleting the current paragraph 8-H.2, and adding a new paragraph 8- H.2 to read as follows. "Alleys shall generally be parallel to the street and shall be paved. The right-of- way for alleys shall be dedicated to the public." 4. By amending SECTION 8: "General Requirements and Minimum Standards of Design" by deleting the current paragraph 8-H.5. 1.
