HomeMy WebLinkAbout1995-2139 - Ordinance - 07/13/1995ORDINANCE NO. 2139 AN ORDINANCE AMENDING ORDINANCE NO. 1638, THE ZONING ORDINANCE OF THE CITY OF COLLEGE STATION, TEXAS, BY AMENDING SECTIONS 7.4, 7.4E, 9.3, Il.lA AND TABLE A OF SECTION 7.22, REGARDING PARKING REQUIREMENTS PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, o.n July 13,.1995, the College Station City Council determined that, in view of the growing population and the increasing number of multifamily residential structures in the City, the existing parking requirements in the College Station Zoning Ordinance no longer provide for adequate parking space and landscaping for the associated multifamily structures; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION: That Section 7.4, of Ordinance No. 1638, the Zoning Ordinance of College Station is hereby amended by adding a new Subsection "G" to read as follows: Landscaping requirements: Each unit shall contain 200 landscape points. All plantings must be drought-resistant and native to this area." II. That Section 7.4E of Ordinance No. 1638, the Zoning Ordinance of the City of College Station is hereby amended to read as follows: IrE. PARKING REQUIREMENTS: Refer to Section 9. Where parking is provided in the front yard, an eight foot (8') setback shall be required between the property line and the nearest side of the parking pad. In addition, an eight foot (8') setback shall be required between the dwelling unit and the nearest side of the parking pad." III. That Section 9.3 of Ordinance No. 1638, the Zoning Ordinance of the City of College Station is hereby amended to read as follows: "9.3 NUMBER OF OFF-STREET PARKING SPACES REQUIRED The number of off-street parking spaces required shall be determined from the following table of OFF-STREET PARKING REQUIREMENTS. The classification of uses referred to shall be deemed to include and apply to all uses. That Section 11.1A of Ordinance 1638, the Zoning Ordinance of the City of College Station is hereby amended to read as follows: The landscaping requirements of this Section shall apply to all land located in the City of College Station and proposed for site development. Such landscaping requirements shall become applicable as to each individual lot at such time as an application for a building permit on such lot is made. The streetscaping requirements of this section shall apply to all land in the City of College Station and proposed for site development or subdivision. Such streetscape requirements shall apply either at the time application is made for building permit or at the time application is made for a final plat, at the discretion of the Zoning Official. All landscaping requirements under this section shall run with the land and shall apply against any owner or subsequent owner." B - Lot Line construction on interior lots is allowed where access to the rear of the building is provided on the site or by dedi- cated right-of-way or e~mement. C - Zero lot line construction of residence is allowed where property on both sides of lot line is owned and/or developed simultaneously by single .l~arty. Development under lot line construction requires prior approval by the Zoning Official. In no case shall a single family residence or duplex be built within 15 feet of another building. D - Minimum front setback may be reduced to 15 feet when approved rear access is provided, or when side yard or rear yard parking is provided. E - The minimum lot width for duplex dwelling may be reduced to 30 t~./DU when all required off-street parking is provided in the rear or side yard. On lots with approved rear access all setbacks shall be measured from the nearest boundary of the access easement or alley. On all other lots rear setbacks shall be measured from the rear property line. In no event shall more than 30% of the rear yard area (that portion of the yard between the rear setback line of the principal slructure and the rear property line) be covered with accessory buildings, structures or uses. O - The maximum building height may exceed 35' ifall setbacks observe an additional setback of 2' for every foot above 35' of building height. H - Minimum rear setback may be reduced to 15 feet when parking is provided in the front yard or side yard. This ordinance shall become effective and be in full force and effect from and after its passage and approval by the City Council and duly attested by the Mayor and City Secretary.
