HomeMy WebLinkAbout1997-2259 - Ordinance - 08/28/1997ORDINANCE NO. 2 2 5 9 AN ORDINANCE AMENDING CHAPTER 10, SECTION 2F, OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION RELATING TO SCHOOL ZONES, PROVIDING A SEVERABILITY CLAUSE; AND DECLARING A PENALTY. WHEREAS, the City Council met at its regular meeting on August 28, 1997, and found that it would be in the best interest and safety of the citizens to amend Chapter 10, Section 2F, of the C~rde of Ordinances by designating a school zone on Rock Prairie Road between Vict~'ia Drive and Shire Drive, with a maximum sp~ed limit-of 25 mph when yellow beicori is flashing, Monday through Friday, more particularly described as follows: Rock Prairie Road from the center of the fight-of- way of Victoria Avefiue west 470 feet to the intersection of Rock Prairie Road and Shire Drive, but not including the intersection of Shire Drive and Rock Prairie Road. NOW, THEI~RFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLt.F-GE STATION: That Chapter 10, Section 2F, of the Code of Ordinances is hereby amended to read as follows: "F. SCHOOL ZONES The City hereby designates school zones on certain streets. A maximum speed limit designated in the Traffic Control D~wice Inventory - Schedule V (dated November 12, 1992) during th'~ hours designated by this ordinance on regularly scheduled days is established within the designated school zones except school zones on state highways where the maximum speed limit shall be determined by the State Department of Public Transportation. The designated school zone speed limits and the hours regulating the time of day that each zone is in effect are described in Traffic ¢0ntr01 Dbwice Invento~ - Schedule V (dated November 12, 1997) on file in the office of the City Secretary. This schedule is hereby adopted and incorporated in this Code as if set out at length herein and is amended by designated school zones as follows: Rock Prairie Road from the center of the right-of- way of Victoria Avenue west 470 feet to the intersection of Rock Prairie Road and Shire Drive, but not including the intersection of Shire Drive and Rock Prairie Road. Page 2 Ordinance No. 2 2 5 9 The schedule may be amended from time to time by ordinance of the City Council. A current schedule shall be maintained by the City Secretary at ail times." That if any pr~visions of any section of this ordinance shall be held to be void or unconstitution~ such holdings shall in no way effect the yaiidity of the remaining provisions or ~ections of this ordinance, which shall remain in full'force~l~d effect. mo That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00). Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. Said Ordinance, being a penal ordinance, becomes effective ten (10) days after its publication in the newspaper, as provided by Section 35 of the Charter of the City of College Station.
