HomeMy WebLinkAbout1997-2234 - Ordinance - 03/13/1997ORDINANCE NO. 2234 AN ORDINANCE RF.7.ONING A 3.767 ACRE TRACT SITUATED IN COLLEGE STATION, BRAZOS COUNTY, TEXAS, AND BEING PART OF THE THOMAS CARUTHERS SURVEY, A-9, CONVEYED TO OWNER, TAC REALTY, INC., BY DEED RECORDED IN VOLUME 1157, PAGE 194, OF THE DEED RECORDS, BRAZOS COUNTY, TEXAS, FROM 4-1, SINGLE FAMILY RESIDENTIAL TO PUD-2, PLANNED UNIT DEVELOPMENT. WHEREAS, on March 13, 1997, the City Council of the City of College Station, Texas, convened and pursuant to notices prescribed by law, held a public hearing with regard to the application for rezoning of a 3.767 acre tract of land situated in the City of College Station, Brazos County, Texas, and being part of the Thomas Caruthers Survey, A-9, conveyed to Owner, TAC Realty, Inc., by deed recorded in Volume 1157, Page 194, of the Official Records, Brazos County, Texas, and more particularly described as follows: Being all that certain tract or parcel of land lying and being situated in the THOMAS CARUTHERS LEAGUE, A-9, in College Station, Brazes County, Texas, and being a portion of the tract of land called 21.32 acres out of Tract No. 5, said Tract No. 5, being a part of the 88.52 acres conveyed by the Federal Deposit Insurance Corporation (FDIC) in its capacity as Liquidator of the First Bank & Trust, Bryan, Texas, to TAC REALTY, INC., by Special Warranty Deed recorded in Volume 1157, Page 194, of the Official Records of Brazes County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING: at a found ½" iron rod marking the common south comer of Lots 13 and 14, Block Twelve, Woodereek Section Three, as shown by plat recorded in Volume 959, Page 797, of the Official Records of Brazes County, Texas; THENCE: S 44° 21' 22" E along the lower northeast line of the said 21.32 acre tract, said line also being the southwest line of the Robert E. and Marguerite H. Carroll tract as recorded in Volume 105, Page 114, and Volume 122, Page 636, of the Brazes County Deed Records for a distance of 352.26 feet to a found ½" iron rod for comer; THENCE: S 33° 41' 57" W continuing along the common line of the said 21.32 acre tract and the Carroll tract for a distance of 324.26 feet to a found ½" iron rod for comer; said iron rod also marking the east comer of a 1.00 acre TAC Realty, Inc. tract as described in Volume 1295, Page 98, of the Official Records of Brazes County, Texas; THENCE: N 84° 07' 02" W along the common line of said 21.32 acre and 1.00 acre tracts for a distance of 274.21 feet to a set ½" iron rod in the southeast right-of-way line of Stonebrook Drive (based on a 60 foot wide public dedication recorded in Volume 1308, Page 281, Official Records of Brazes County, Texas); THENCE: N 05° 52' 58" E along the said line of Stonebrook Drive for a distance of 429.66 feet to a set ½" iron rod for the Point of Curvature of a curve to the leR; THENCE: 60.96 feet along the arc of said curve having a central angle of 02° 23' 56", a radius of 1455.99 feet, a tangent of 30.48 feet and a long chord bearing N 04° 41' 15" E at a distance of 60.95 feet to a found ½" iron rod for comer; THENCE: N 88° 02' 22" E for a distance of 157.48 feet to the POINT OF BEGINNING and containing 3.767 acres of land, more or less. iah~c:luserfilg~rezonmglwoodcrk8.doc 3/2 4/9 7 ORDINANCE NO. 2234 PAGE 2 WHEREAS, the above-described property is currently zoned R-l, Single Family Residential, and tl~ current use is as vacant land; WHEREAS, the current owner of the above-described property, TAC Realty, Inc., has applied for rezoning of the property to PUD-2, Planned Unit Development; WHEREAS, the City Council of the City of College Station, Texas, heard evidence as to the location of the above-described property along the east fight-of-way of Stonebrook Drive and to the immediate south of Woodcreek Section 3; WHEREAS, the City Council of thc City of College Station, Texas, heard evidence that there is a growing population in the City who prefer to live in a residential area that provides homeowner's association to take care of all landscaping and lawn maintenance needs; WHEREAS, evidence was presented that the above-described property is located directly across from a current PUD-2 area on the west side of Stonebrook Drive; WHEREAS, evidence was presented that the green space provided by rezoning the above-described property as PUD-2 will provide a natural buffer for the adjacent property, currently zoned C-3, Planned Commercial; and WHEREAS, evidence was presented that the proposed zoning change is in compliance with the City's Comprehensive Plan and proposed Comprehensive Plan; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the above-described property is rezoned to PUD-2, Planned Unit Development, effective immediately.
