HomeMy WebLinkAbout1996-2203 - Ordinance - 08/29/1996ORDINANCE NO. 2203 AN ORDINANCE gl.ZONING A 21.497 ACRE TRACT SITUATED IN THE MORGAN RECTOR LEAGUE, ABSTRACT NO. 46 IN THE CITY OF COLLEGE STATION, BRAZOS COUNTY, TEXAS, SAID TRACT BEING A PORTION OF A 23.21 ACRE TRACT AS DESCRIBED BY A DEED TO ~IOE C. FAZZINO TRUSTEE, RECORDED IN VOLUME 455, PAGE 507 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS, FROM R-I SINGLE FAMII.Y RESIDENTIAL TO C-1 GENERAL-COMMERCIAL. WHEREAS, on August 29, 1996, the City Council of the City of College Station convened and, pursuant to notices prescribed by law, held a public hearing with regard to the application for the rezoning ora 21.497 acre tract of land situated in the Morgan Rector League, Abstract No. 46, in the City of College Station, Brazos County, Texas, and more particularly described as follows: BEING ALL THAT CERTAIN TRACT OR PARCEL OF LAND, LYING AND BEING SITUATED IN THE MORGAN RECTOR LEAGUE, ABSTRACT NO. 46, COLLEGE STATION, BRAZOS COUNTY, TEXAS; SAID TRACT BEING A PORTION OF A CALLED 23.21 ACRE TRACT AS DESCRIBED BY A DEED TO JOE C. FAZZINO TRUSTEE, RECORDED IN VOLUME 455, PAGE 507 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS. Said tract being more particularly described by the metes and bounds as follows: BEGINNING at a 3/8 inch iron road found marking the North comer of said 23.21 acre tract and the West comer of a called 1.92 acre tract as described by a deed to LFR Properties, Ltd. recorded in Volume 1848, Page 183, of the Official Public Records of Brazos County, Texas; THENCE: Along the common line of said 1.92 acre tract and said 23.21 acre tract for the following calls: S 52° 14' 22" E for a distance of 119.73 feet to a 5/8 inch iron rod found; S 48° 04' 00" E for a distance of 255.16 feet to a 5/8 inch iron rod set; THENCE: Through said 23.21 acre tract for the following calls: S 41° 25' 41" W for a distance of 19.94 feet to a 5/8 inch iron rod set; S 19° 58' 41" W for a distance of 468.75 feet to a 5/8 inch iron rod set; S 19° 49' 23" W for a distance of 167.54 feet to a 5/8 inch iron rod set; S 42° 04' 37" W for a distance of 124.49 fee{ to a 1/2 inch iron rod found marking the North corner ora called 12.91 acre tract as described by an extension of real estate note and lien, recorded in Volume 1135, Page 43 of the Official Records of Brazos County, Texas; THENCE S 42° 02' 04" W along the northwest line of said 12.91 acre tract for a distance of 931.46 feet to a 5/8 inch iron rod set on the Northeast right-of-way line of State Highway No. 6 (Business) a.k.a.. Texas Avenue, for reference a I inch iron pipe found bears: S 42° 02' 04" W for a distance of 1.60 feet and a 5/8 inch ja/c/r~zone96/plearant dc~ 11/5/96 Ordinance No. 2203 Page 2 iron rod found marking the South comer of said 12.91 acre tract bears: S 48° 34' 19" E for a distance of 603.74 feet; THENCE: N 48° 34' 19" W along said right-of-way line for a distance of 601.72 feet to a 5/8 inch iron rod set marking the West comer of said 23.21 acre tract and the South comer of Rosewood Office Park according to plat recorded in Volume 868, Page '/58 of the Official Records of Brazos County, Texas, for reference a 3/8 inch iron rod found bears: S 41° 41' 42" W for a distance of 0.61 feet; THENCE: N 41° 41' 42" E along the common line of said 23.21 acre tract, Rosewood Office Park and Lakeview Acres Revised according to the Plat recorded in Volume 128, Page 300 of the Deed Records of Brazos County, Texas for a distance of 1535.97 feet to a 5/8 inch iron rod set marking the East comer of said Lakeview Acres Revised, for reference a 1/2 inch iron rod found bears: S 06° 43' 33" E for a distance of 107 feet; THENCE: N 40° 33' 51" E for a distance of 126.54 feet to the Point of Begin- ning, containing 21.497 acres of land as surveyed on the ground July 1996. Bearing orientation is based on Grid North as established from the City of College Station G.P.S. Monument No. 130. WHEREAS, the above-described property is currently zoned R-1 Single Family Residential and the current use conforms with the existing zoning; WHEREAS, the owner of the above-described property, Pleasant Forest Partnership, has applied for the rezoning of the above-described property to C-1 General Commercial; WHEREAS, the City Council of the City of College Station, Texas, heard evidence that adjacent properties are currently zoned for commercial use; WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the proposed zoning change is in accordance with the Comprehensive Plan and proposed Compre- hensive Plan; WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the proposed zoning change of the above-described property from R-1 to C-1 could contribute to economic growth as the result of a higher tax base; WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the physical constraints of the above-described property prohibit further residential development; WHEREAS, the City Council of the City of College Station, Texas, heard recommendations from the Planning and Zoning Commission that the property be rezoned subject to the following special conditions: That there be no disturbance of the floodway; That the floodway remain R-l; and That a buffer be established between the abutting existing R-1 zone (future medium density residential) and the requested C-1 zone. js/e.,/rczon~-96/pleasm~doo 11/$/96 Ordinance No. 2203 Page 3 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the entire 21.497 acre tract described above is rezoned to C-1 Creneral Commercial, with the special conditions set out above, effective immediately.
