HomeMy WebLinkAbout2000-2472 - Ordinance - 09/14/2000ORDINANCE NO. 2472 ORDINANCE RATIFYING ORDINANCE AUTHORIZING THE ISSUANCE OF $8,100,000 CITY OF COLLEGE STATION, TEXAS CERTIFICATES OF OBLIGATION, SERIES 2000A AND OTHER MATTERS RELATED THERETO, INCLUDING IMMEDIATE EFFECTIVENESS WHEREAS, the City Council has heretofore, on July 13, 2000, passed a resolution authorizing and directing the City Secretary to give notice of intention to issue the Certificates of Obligation (the "Certificates") in the original aggregate principal amount of $8,100,000 for the purpose of providing for the payment of contractual obligations to be incurred for financing for construction of a parking garage in the Northgate area, acquisition of parking meters, and acquisition of land, being approximately 5.79 acres on Texas Avenue between Krenek Tap Road and King Cole Drive, and of the payment of contractual obligations for professional services in connection therewith (to wit: architectural, financial advisory, legal, and engineering); WHEREAS, the published notice incorrectly identified the proposed sources of payment of the Certificates and a correct notice has been published in The Eagle on August 31, 2000 and September 7, 2000, the date of first publication being at least 14 days prior to the date hereof; WHEREAS, the City has received no petition from the qualified electors of the City protesting the issuance of the Certificates; and WHEREAS, City Council has passed Ordinance No. 2463 on August 10, 2000, being an "Ordinance Authorizing the Issuance of $8,100,000 City of College Station, Texas Certificates of Obligation, Series 2000A and Other Matters Related Thereto, Including Immediate Effectiveness (the "Ordinance"); NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, THAT: Section 1. Ratification of Ordinance. The Ordinance is hereby ratified, confirmed, and reenacted and in accordance therewith there is hereby authorized to be issued and delivered, a series of certificates of obligation of the City, to be known as "CITY OF COLLEGE STATION, TEXAS CERTIFICATES OF OBLIGATION, SERIES 2000A" (the "Certificates"), in the original aggregate principal amount of $8,100,000 payable from ad valorem taxes and a limited pledge of $1,000 of the surplus revenues of the City's utility system, for the purposes described therein. Section 2. Miscellaneous Provisions. (a) Titles Not Restrictive. The titles assigned to the various sections of this Ordinance are for convenience only and shall not be considered restrictive of the subject matter of any section or of any part of this Ordinance. (b) Inconsistent Provisions. All orders and resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Ordinance are hereby repealed and declared to be inapplicable, and the provisions of this Ordinance shall be and remain controlling as to the matters prescribed herein. (c) Severability. If any word, phrase, clause, paragraph, sentence, part, portion, or provision of this Ordinance or the application thereof to any person or circumstances shall be held to be invalid, the remainder of this Ordinance shall nevertheless be valid and the City hereby declares that this Ordinance would have been enacted without such invalid word, phrase, clause, paragraph, sentence, part, portion, or provisions. (d) Governing Law. This Ordinance shall be construed and enforced in accordance with the laws of the State of Texas. (e) Open Meeting. The City officially finds and determines the meeting at which this Ordinance is adopted was open to the public and that public notice of the time, place, and purpose of such meeting was given, all as required by Chapter 551, Texas Government Code. (f) Immediate Effect. Notwithstanding any charter provision or other applicable laws, this Ordinance shall immediately effective upon its adoption by the City Council. (g) Incorporation of Preamble. The preamble to this Ordinance is incorporated by reference in this Ordinance. PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS this 14th day of September, 2000, at which meeting a quorum was present.
