HomeMy WebLinkAbout2002-2599 - Ordinance - 12/19/2002ORDINANCE NO 2599 AN ORDINANCE AMENDING CHAPTER 12, "ZONING", SECTION 7.21.C, "REVIEW PROCESS", OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY REVISING THE COMPOSITION OF THE DESIGN REVIEW BOARD AS SET OUT BELOW; PROVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That Chapter 12, "ZONING", Section 7.21.C, "REVIEW PROCESS", of the Code of Ordinances of the City of College Station, Texas, be amended as set out in Exhibit "A", attached hereto and made a part of this ordinance for all purposes. PART 2: That if any provisions of any section of this ordinance shall be held to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections of this ordinance, which shall remain in full force and effect. PART 3: That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dollars ($25.00) nor more than Two Thousand Dollars ($2,000.00). Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. Said Ordinance, being a penal ordinance, becomes effective ten (10) days at, er its date of passage by the City Council, as provided by Section 35 of the Charter of the City of College Station. APPROVED: ATTEST: Conhie Iioo]~s, Cft~ffe~r-etar~ City Attorney ORDINANCE NO. 2599 Page 2 EXHIBIT "A" That Chapter 12, "Zoning", Section7.2 I.C, "REVIEW PROCESS", of the Code of Ordinances of the City of College Station, Texas, is hereby amended to read as follows: C REVIEW PROCESS All development projects prooosed within the corridor shall be reviewed by the Design Review B_oard (DRB). TI/e DRB shall be a body appointed by the City Council and sh~ll consist of (1) one registered architect, (.2) one l.andscape architect (3) one business person, (_4) one member knowledgeable in aesmetic ju.dgment, (5}one landowner or deyelo_per in the Wolf Pen Creek Corridor, (6) one citizen at large, and the voting members of tl~e Project Review Committee, b~n,g a. committee establishe_~ by the City's Zoning Ordinance. The D.RB.. shall be suooorted Ey tl~e same technical start-as the Project Review Committee. The. initial term of office shall be two (2)years for the business .person .and the .architect and three (3) years for the landscape architect, tl~e exoert in aesthetic judgment, the citizen at large, and the landowner. All terms thereafter shalI be for three (3) years. The. DRB, in reviewing each prooosal, shall consider the City's l.and use and development codes, the Wolf Pen C~eek Corridor Study and Master Plan, and the standards and policies hereinorovided. Standards and policies herein take precedence over other applicable codes and ordinances where conflict erasts. The following factors and characteristics, which affect the apgearance of a development, will govern fli'e Design Review Board's evaluation of a design submission: Conformance to the City's land use and development codes and this ordinance. Logic of design. E. xt.erior space.utilization. Architectural cttaracter. Attractiveness. Material selection. Harmony and compatibility. . Circulation - vehicular and pedestrian. Maintenance aspects.
