WITNESSETII:
Pursuant to the authority granted by the Texas
Interlocal Cooperation Act (Article 4413 (32c) V.A.T.S.)

b,,dies, the parties hereto, in consideration of the premises
and mutual promises contained herein, agr~;e as follows:
The City of College Station, Texas, hereinafter
referred to as "City," makes, constitutes and appoints the
Texas Municipal Power Agency, its true and lawful purchasing
~, .~e n t fey the purchase of certain items through their
purchasing program. Said items will be specified by the
City through the submission of purchase orders duly signed
,,y an appropriate offic:ial. City agrees that the bidding
-shall bu conducted by and according to the Texas Municipal
Power Agency's Financial and Accounting procedures.
II.
The City agrees that all specifications for said items
~hall be as determined by the Texas Municipal Power Agency.
III .
The City, by execution of this agreement, agrees to
f:,rn!sh to the Texas Municipal Power Agency a valid Purchase
Order that encumbers payment from revenues of the City in
full payment of the stated ordrr. The City will issue a
~;hock for payment of the artlc],'(s) so ordered through the
Texas Municipal Power Agency wilhin 14 clays of delivery of
s;~ld articles and receipt of an invoic,; for payment from the
