HomeMy WebLinkAbout2004-2740 - Ordinance - 08/09/2004ORDINANCE NO. 2760 AN ORDINANCE AMENDING CHAPTER 9, "SUBDIVISIONS", OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY AMENDING CERTAIN SECTIONS AS SET OUT BELOW; PROVIDING A SEVERABILITY CLAUSE. DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS PART I' That Chapter 9, "SUBDIVISIONS", of the Code of Ordinances of the City of College Station, Texas, be amended as set out in Exhibit "A", attached hereto and made a part of this ordinance for all purposes PART 2. That if any pmvtstons of any section of th~s ordinance shall be held to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections ofthls ordinance, which shall remain in full force and effect PART 3. That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed gudty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty Five Dollars ($25.00) nor more than Two Thousand Dollars ($2,000 00). Each day such vtolation shall continue or be permitted to continue, shall be deemed a separate offense. Said Ordinance, being a penal ordinance, becomes effective ten (10) days after its date of passage by the City Council, as provided by Sectton 35 of the Charter of the City of College Station PASSED. ADOPTED and APPROVED this 9th day of August .2004 ATYEST' Connie Hooks, City Secretary APPROVED: City Attorney ORDINANCE NO. 2740 Page 2 EXHIBIT "A" That Chapter 9, "SUBDIVISIONS", of the Code of Ordinances of the City of College Station, Texas, is hereby amended as follows' 1. By amending SECTION 5' "VARIANCES" by adding a new paragraph 5-C to read as follows "5-C. Variance from Water Flow Reautremems It is specifically intended and hereby provided that the various provisions of Section 5, "Variances", shall not apply to fire flow prows~ons set out in Paragraphs 8-O. 12-P 4 and 13-D" By amending SECTION 8' "GENERAL REQUIREMENTS AND MINIMUM STANDARDS OF DESIGN", by deleting the current paragraph 8-0 and adding a new paragraph 8-0 to read as follows ".8-O Water Suoolv All sub&visions shall be provided with water supply and chsmbutwn systems for fire protection and domestic use All water mains, distnbut~on and service lines shall be constructed as provided by the Bt?re~College Station Unified Design Guidehnes and the Bryan/College Station Untried Technical Spec~catlons and all applicable state and federal requirements Where there is a conflict of standards, the more stnngent standard as determined by the City Manager, or his designee, shall apply. The City shall accept for public use only water mains, dlsmbution and service lines that comply with these standards for constroction." 3 By amending SECTION 12' "RURAL RESIDENTIAL SUBDIVISION REGULATIONS", by deleting the current paragraph 12-P.4 and adding a new paragraph 12-P.4 to read as follows' "12-P.4 Rural Water Suoolier Water for all rural subdivisions shall be as provxded by the City Standards. The requirements will include the fire flow requirements as provided by thc International Fire Code and the Bo'an/College Statton Unified Design Guidehnes and the Bryan/College Station Unified Techmcal Specifications and all apphcable state and federal reqturements" OKDINANCF. NO. 27~,0 Page 3 By amending SECTION 12' "RURAL RESIDENTIAL SUBDIVISION REGULATIONS", by repealing sub-section 12-Q Fire Protection By amending SECTION 13. "SPECIAL CONDITIONS IN AREA OF EXTRATERRITORIAL JURISDICTION" by deleting the current paragraph 13- D and by adding a new paragraph 13-D to read as follows. "13-D. Water Water for all ETS subdivisions shall be as provided b.y thc City Standards. The reqmrements will include the fire flow requirements as provided by the International Fire Code and the Bryan/College Station Untried Design Guidehnes and the B~.an/College Statton Untried Techmcal Specifications and all applicable state and federal requirements."
