Chairperson Kee called the meeting to order at 11:00 a.m. AGENDA ITEM NO. 2: Consideration, discussion and possible action to approve meeting minutes. • July 13, 2018 Board member McKinney motioned to approve the minutes. Board member Durden seconded the motion, which passed (4-0). Commissioner Susan McGrail was absent for this vote. AGENDA ITEM NO. 3: Consideration, discussion and possible action to approve absences from meetings. • Katherine Cabrera ~ September 14, 2018 Board member McKinney motioned to approve the absence. Board member Durden seconded the motion, which passed (4-0). Commissioner Susan McGrail was absent for this vote and came in as we started Agenda Item No.4. AGENDA ITEM NO. 4: Presentation, possible action, and discussion to consider Alternative Compliance to the Unified Development Ordinance Section 7.10 Non-Residential Architectural Standards for the City of College Station Police Annex located at 800 Krenek Tap Road. Case # NRA2018-00047 (A. Helton) Senior Planner Helton presented the item to the Board. She stated that the applicant is requesting an alternative compliance to the UDO Non-Residential Architectural Standards. The applicant presented the plans for the Annex building and discussed the type of materials that would be used and the location of the building. There was general discussion amongst the Board regarding the look and type of materials that were proposed including the landscaping, the location of the building and if it would be viewable from the street. Board Member Miranda motioned to approve the request. Board Member McKinney seconded the motion which passed (5-0). AGENDA ITEM NO. 5: Possible action and discussion on future agenda items – A Design Review Board Member may inquire about a subject for which notice has not been given. A statement of specific factual information or the recitation of existing policy may be given. Any deliberation shall be limited to a proposal to place the subject on an agenda for a subsequent meeting. There was general discussions amongst the board regarding a possible future presentation of bicycle racks. Chair Kee requested that Staff look into whether or not the Design Review Board had discretion over bicycle rack standards. AGENDA ITEM NO. 6: Adjourn. The meeting was adjourned at 11:40 pm. Hovde, Senior Planner lhovde@cstx.gov Design Review Board October 12, 2018 Page 2 of 5 Design Review Board October 12, 2018 Page 3 of 5 DESIGN REVIEW BOARD ROLE AND RESPONSIBILITY As stated in Section 5.8.B.1.a of the Unified Development Ordinance, NG-1 Core Northgate District is intended to be a mixed-use district “containing a diversity of pedestrian-oriented retail, dining/restaurant, housing, and entertainment businesses are in close proximity to on- and off-campus dormitories. Regulations are designed to aid structural rehabilitation and redevelopment while promoting new high density, mixed use, pedestrian-oriented infill development with an urban character. One aspect of implementation is the requirement that sidewalks be eight (8) feet wide on all public streets in Northgate, other than those specified as having additional width requirements, as part of the site planning or platting process per Section 5.8.B.8 which states: “Sidewalks shall be incorporated into all proposed development and redevelopment projects within any Northgate district. In the event that a sidewalk exists on a site prior to development or redevelopment and does not meet all sidewalk and streetscape standards outlined herein, the sidewalk must be upgraded to meet current standards (including American National Standards and Texas Accessibility Standards).” The Unified Development Ordinance grants the Design Review Board (DRB) the authority to hear and decide upon waivers to the Northgate Standards, per Section 5.8.B.14.o which states: “Relief from the sidewalk width standard when bringing an existing sidewalk up to current standard where existing physical conditions prohibit the sidewalk expansion.” Based on these criteria, the Design Review Board can act upon the proposed request in one or a combination of the following ways: • Approve the requested relief of two (2) feet • Approve a partial relief of less than two (2) feet • Approve with conditions • Deny ITEM SUMMARY: The applicant is proposing to demolish and replace an existing outdoor concrete and brick patio of approximately eleven (11) feet in width. The abutting sidewalk along Patricia Street is six (6) feet wide and would require an additional (two) 2 feet of sidewalk dedication and construction. This dedication may come in the form of right-of-way or public access easement. If the sidewalk is widened to the required 8-foot width, the alteration would also result in the installation of street trees with tree wells located at back of curb and street benches as these items are associated with sidewalk improvements during the site planning process in Northgate. The existing concrete patio is elevated from Patricia Street right-of-way in a graduated manner ranging from at-grade to approximately eighteen (18) inches (closest to the park spaces, as shown below in Google Street View circa January 2013). All canopy trees within the patio area have been removed due to deterioration of tree health and the presence of birds within the area of food and beverage consumption. The existing design, including the brick border along the patio edge, was approved by the Design Review Board in 2003 as part of a former exterior remodel. This action was not accompanied by a waiver request, but was made at a time before Northgate plans could be approved by Staff. At the time, the requirement of an 8-foot sidewalk was not in place. This width was specified in 2006 with the current Northgate District Standards. The applicant is proposing to remove the existing elevated portion of the patio, due to the concrete and railing falling into disrepair, as part of an overall exterior refurbishment project they are Design Review Board October 12, 2018 Page 4 of 5 undertaking. This project also includes the removal and replacement of exterior awnings and columns in an alternate configuration. Due to the removal of the patio in its entirety, it exceeds what can be considered basic maintenance and therefore is subject to site planning requirements which include the sidewalk improvements. CRITERIA: According to UDO Section 5.8.B.14, the DRB “shall approve waivers found to meet the intent of the standards of the Northgate Districts section of this UDO and the Northgate Redevelopment Implementation Plan. Financial hardship may not be considered in the review or determination of a waiver proposal.” Further the Unified Development Ordinance grants the Design Review Board (DRB) the authority to hear and decide upon waivers to the Northgate Standards, per Section 5.8.B.14.o for, “Relief from the sidewalk width standard when bringing an existing sidewalk up to current standard where existing physical conditions prohibit the sidewalk expansion.” Staff believes the intent of the ordinance is met due to the following: • ADA accessibility clearance exists along the existing sidewalk; • The closure of College Main results in low vehicular activity and increased pedestrian usage of Patricia Street; and • The outdoor commercial activity provided through patio seating adds to the pedestrian-level interest of the District. Staff has consulted with Community Development in regards to pedestrian safety and usage along Patricia Street, and was informed that the current situation is functioning adequately. During peak hours (9:00 pm – 3:00 am Thursday-Saturday, as well as Police or Special Event specified times), Patricia Street, Lodge Street, and College Main from Patricia Street to Church Avenue are closed to vehicular traffic. While open during non-peak hours, these streets have experienced an increase in pedestrian use due to the growth in multi-family developments in the surrounding area.
