HomeMy WebLinkAbout1954-0194 - Ordinance - 09/13/1954f0 z STANDARD B & P ORDINANCE NO. 194 AN ORDINANCE ABANDONING A PORTION CF LAND LYING AND BEING ADJACENT TO A PROJECTION OF FAIRVIEW AVENUE AS SUCH PROJECTION IS MADE IN A STRAIGHT LINE FROM LOT SEVEN (7) BLOCK NINE (9) TO LOT SEVEN (7) BLOCK THIRTEEN (13) OF COLLEGE PARK, AN ADDITION TOM C]TY OF COLLEGE STATION, BRAZOS COUNTY, TEXAS, ACCORDING TO PLAT OF SAID ADDITION RECORDED IN VOL. 38 PAGE 604, DEED RECORDS OF BRAZOS COUNTY, TEXAS, AND AISO ABANDONING A PORTION CF LAND LYING AND BEING ADJACENT TO A PROJECTION OF FAIRVIEW AVENUE AS IT IS PROJECTED IN A STRAIGHT LINE FROM LOT FIVE (5) BLOCK TEN (10) TO LOT ELEVEN (11) BLOCK FOURTEEN (14) OF SAID COLLEGE PARK ADDITION TO THE CITY OF COLLEGE STATION, BRAZOS COUNTY, TEXAS. WHEREAS, by an instrument dated June 12, 1923, executed by F. B. Clark, Chairman, Board of Directors, South Side Development Company, recorded in Vol. 38 page 604, Deed Records of Brazos County, Texas, a revised plan, map, or plat of College Park, an addition adjoining the "Agricultural College of Texas," College Station, Brazos County, Texas, was filed for record, which said map or plat probably constituted a dedication to the public of the streets indicated thereon, and WHEREAS, said plat indicated that Fairview Avenue, which was in all other places a 50 --- foot wide street, appeared to become 150 feet wide at a point where it adjoined Block 13 on its south or southwest side and Block 14 on its . north or northeast side, and continued to be 150 feet wide for a distance of 150 feet, at which point its width again became 50 feet, which width continued for the remainder of its length, and � , on July 2, 1941, the City of College Station approved a resubdivisi n of a portion of College Park according to a map or plat of said resubdivision recorded in Vol. 107 page 151, Deed Records of Brazos County, Texas, which said resubdivision indicated Fairview Avenue to be a street 50 feet in width for its entire length and which map or plat did not show the apparent broadening of Fairview Avenue as previously described which said approval impliedly abandoned all claim of the City of College Station to the above described expanded portion of Fairview Avenue, and WHEREAS, since such date, the City of College Station has levied and collected ad valorem taxes from individual property owners on that portion of Fairview Avenue which was formerly the expanded part of Fairview Avenue, and WHEREAS, the City of. College Station has never accepted the dedication, if any, of the expanded portion of Fairview Avenue as a public street, thoroughfare, park, recreation center, or for other public usage because of the impracticality and expense of maintaining such property as a public street, thoroughfare,R park, or recreation, or other public usage. NOW THEREFORE l BE TT ORDAINED by the City Council of the City of College Station, Texas, that the following property is hereby and henceforth shall be abandoned as a 7, portion of a street by the City of College Station: All that certain tract or parcel of land, lying and being adjacent to the northeast line of Lots One (1) and Six (6) in Block Thirteen (13) in CO 00474 z 0 College Park, an addition to the City of College Station, according to plat of said addition recorded in Vole 38 page 604, Deed Records of Brazos County, Texas, and lying and being adjacent to a projection. of the southwest line of Fairview Avenue as said Fairview Avenue is projected in a straight line from Lot Seven (7) Block Nine (9) to Lot Seven (7) Block Thirteen (13) of College Park according to said plat, and also that portion of land lying and being adjacent to the southwest side of Lots One (1) and Five (5) of Block Fourteen (14) of said addition and being adjacent to a projection of the northeast line of Fairview Avenue as said avenue is projected in a straight line from Lot Five (5) Block Ten (10) to Lot Eleven (11) Block Fourteen (14) of said Addition.
