HomeMy WebLinkAbout1968-0577 - Ordinance - 06/24/1968ORDINANCE NO. 577 AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF IMPROVING PORTIONS OF WINDING ROAD, LANGFORD STREET, FIRST STREET, PARK PLACE STREET, SPRUCE STREET, KERRY STREET AND NORTH WALTON DRIVE IN THE CITY OF COLLEGE STATION, TEXAS, WITHIN THE LIMITS BELOW DEFINED, PERFORMED BY YOUNG BROS. CONTRACTORS, INC.; AUTHORIZING AND DIRECTING THE ISSUANCE OF SPECIAL ASSESSMENT CERTIFICATES IN CONNECTION THEREWITH; DECLARING AN EMERGENCY; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFII CTIVE IMMEDIATELY UPON ITS PASSAGE. BE IT ORDAINED by the City Council of the City of College Station, Texas: Section I. That the work of improving the following streets or portions thereof in the City of College Station, to wit: All that certain portion of Winding Road described as follows: Commencing at the intersection of Winding Road and Caudill Street thence in a northeasterly direction along Winding Road until same intersects Langford Street; and All that certain portion of Winding Road described as follows: Commencing at the intersection of Winding Road and South Dexter Drive thence in a southeasterly direction along Winding Road until same intersects County Road; and All that certain portion of Langford Street described as follows: Commencing at the intersection of Langford Street and Winding Road thence in a northwesterly direction along Langford Street until same intersects Orr Street; and All that certain portion of First Street described as follows: Commencing at the intersection of First Street and Patricia Street thence in a northwesterly direction along First Street until same intersects the city limits; and All that certain portion of Park Place Street described as follows:, Commencing at the intersection of Park Place Street and Lee Avenue thence in a southwesterly direction along Park Place Street until same intersects South Dexter Drive; and All that certain portion of Spruce Street described as follows: Commencing at the intersection of Spruce Street and First Street thence in a northeasterly direction along Spruce Street until same intersects Boyett Street; and All that certain portion of Park Place Street described as follows: Commencing at the intersection of Park Place Street and alley between Timber Street and Lee Avenue thence in a southwesterly direction along Park Place Street until same intersects Lee Avenue; and All that certain portion of Kerry Street described as falows: Commencing at the intersection of Kerry Street and Fairview Avenue thence in a northeasterly direction along Kerry Street until same intersects West Dexter Drive; and 01.459 0 0 1;1 BOORUM & PEASE All that certain portion of North Walton Drive described as follows: Certain portions of North Walton Drive abutting Lots 4 through 11, Block 1, College Hills Estates; by placing improvements to Winding Road, Langford Street, First Street, Spruce Street and Kerry Street consisting of a four (4) inch compact depth Hot Mix Asphaltic Base with a one (1) inch asphalt plant mix with concrete curbs to a width, measured from back to back of 31 feet, as provided in said plans and specifications; and placing improvements to Park Place Street from the intersection of Park Place and Lee Avenue southwesterly to the intersection of Park Place Street and South Dexter Drive consisting of a four (4) inch compact depth Hot Nix AsphalticBase with a one (1) inch asphalt plant mix with concrete curbs to a width, measured from back to back of 37 feet, as provided in said plans and specifications; and by placing improvements to Park Place Street from the intersection of Park Place Street and alley between Timber Street and Lee Avenue southwesterly to the intersection of Park Place Street and Lee Avenue consisting of a four (4) inch compact depth Hot Mix Asphaltic Base with a one (1) inch asphalt plant mix with concrete curbs to a width, measured from back to back of 27 feet, as provided in said plans and specifications; and by placing improvements to certain portions of North Walton Drive abutting Lots 4 through 11, Block 1, College Hills Estates, consisting of a four (4) inch compact depth Hot Mix Asphaltic Base with a one (1) inch asphalt plant mix with concrete curbs varying in width, measured from back to back, as provided in said plans and specifications and the said work having been performed and completed in accordance with the provisions and terms of the contract and the plans and specifications therein contained dated May 24, 1967, between the City of College Station and Young Bros. Contractors, Inc., the city engineer of the said City having measured, examined and caused to be tested the finished improvements by the means and in the manner provided by the terms of such contract and the plans and specifications therein contained, and the said city engineer having found that such improvements have been constructed and completed in full compliance with such contract and the plans and specifications therein contained, and having approved and accepted said improvements and work and having heretofore issued his certificate of final acceptance, and having so certified to the City Council of the City of College Station, Texas, and having recommended that such City Council accept and receive said work and improvements as constructed by said Young Bros. Contractors, Inc., and the said work and improvements having been found by the Mayor and said City Council of the said City of College Station, to have been performed and completed in full compliance with the terms of said contract and plans and specifications, the same are hereby, now accepted and approved by the City Council of the City of College Station, Texas. Section II. That the Mayor and City Secretary of said City are hereby authorized and directed to issue to the City of College Station special assess- ment certificates evidencing the assessments against property improved abutting upon said streets within the limits above defined and against the real and true owner or owners thereof; said assessment certificates to be executed in the name of the City of College Station by the Mayor and City Secretary thereof and impressed with the seal of the City and dated as to the day thereof, and such officers are hereby authorized and directed to execute said certificates in their official capacities on behalf of said city and deliver same to the City of College Station, Texas. 01460. Section III. That it is necessary to immediately complete the improve- ments upon the hereinabove streets in said City and to complete the assess- ments levied for a portion of the cost of said improvements upon and against the properties abutting upon said streets and the owners thereof, creates a public emergency and this ordinance should be passed on this day and shall take effect as an emergency measure and be in full force from and after its passage and it is so ordained.
