SERVICE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:

That Chapter 1, Section 5, of the Code of Ordinances of the City of College Station,
Texas, pertaining to the General Penalty, is hereby amended to read as follows:
"SECTION 5: GENERAL PENALTY FOR VIOLATIONS
Whenever in this Code or in any ordinance of the City an act is prohibited or is made or
declared to be unlawful or an offense or a misdemeanor, or wherever in such Code or
Ordinance the doing of an act is required or the failure to do any act is declared to be
unlawful, the violation of any such provision of this Code or any such ordinance shall be
pun ,shed by .a. fine of not exceeding Two Thousand Dollars ($2.,000.00) for violations of
mumc!pal ordInances that govern fire safety, sanitation (not including vegetation and
litter v,olations), public health, and rezoning or as the Legislature may amend from time
to time. For traffic related offenses and other violations not included in the classes
enumerated above, the maximum permissible fine will be Five Hundred Dollars
($500.00) or as the Legislature may amend from time to t~me. Further, that the above
mentioned violations shall be subject to a minimum fine of Twenty-five Dollars ($25.00),
except for parking violations. PROVIDED, however, that no penalty shall be greater or
less than the penalty provided for the same or similar offense under the laws of the
state. Each day any violation of this Code or of any ordinance shall continue shall
constitute a separate offense."
That Chapter 1, Section 11.F(1), of the Code of Ordinances of the City of College
Station, Texas, pertaining to Hotel Occupancy Tax, is hereby amended to read as
follows:
"F. Penalties
(1) Failure to File or Filina False Reoort
If any person required by the provisions of this section to collect the tax
imposed herein, or make reports as required herein, and pay to the tax
collector the tax imposed herein, shall fail to collect such tax, file such
report, or pay such tax, or if any such. person shall file a false report, such
person shall be deemed guilty of a m~sdemeanor and upon conviction be
,~unished by a fine pursuant to the General Penalty sat out in Chapter 1,
ection 5, of thisCodeof Ordinances, and shall pay to the tax collector
the tax due, together with a penalty of five percent (5%) of the tax due for
each thirty (30) days that the same is not timely filed or paid."
That Chapter 1, Section 13, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Alcoholic Beverages, is hereby amended by adding a Section E to
read as follows:

"E. Penalty
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances."
That Chapter 1, Section 14.1(3), of the Code of Ordinances of the City of College
Station, Texas, pertaining to Conduct of Persons Within Park and Recreation Areas of
the City, is hereby' amended to read as follows:
"(3) Penalty
Anyone violating this section shall be guilty of a misdemeanor and upon
conviction shall be fined pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances."
That Chapter 1 Section 15, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Disposal of Unclai_m. ed and Surplus Property, is hereby amended
by adding a Section G to read as follows.
"G. Penalty
A wolation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances."
That Chapter 1, Section 16.C, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Firearms, is hereby amended to read as follows:
"C. PenalW
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances."
That Chapter 1, Section 17.F, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Certain Acts Prohibited on Public and Private Property, is hereby
amended to read as follows:
"F. PenalN
Any person violating this section shall be fined pursuant to the General Penalty
set out in Chapter 1, Section 5, of this Code of Ordinances."

That Chapter 1, Section 19, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Sale, Distribution, or Display of Harmful Material to Minors, is
hereby amended by adding a Section C to read as follows:
"C. Penalty
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty sat out in
Chapter 1, Section 5 of this Code of Ordinances."
That Chapter 1, Section 20.D(1), of the Code of Ordinances of the City of College
Station, Texas, pertaining to Disorderly Conduct, is hereby amended to read as follows:
"(1)
Any person who shall violate the provisions of this section, after being warned by
any City p.olice officer or b.y any person i.n charge of s.uch properties to abate
such violatEon, shall be subject to prosecubon and penalties as set out in Chapter
1, Section 5, of this Code of Ordinances."
10.
That Chapter 1, Section .~...B, of the Code of Ordinanc?s of the City of College Station,
Texas, pertaining to Neighborhood Watch Program, ~s hereby amended to read as
follows:
"B. Penalty
The posting of a Neighborhood Watch sign without compliance with the require-
ments of Subsection A of this Ordinance shall be an offense punishable by a fine
pursuant to the General Penalty sat out in Chapter 1, Section 5, of this Code of
Ordinances."

That Chapter 1, Section 24.H, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Guidelines for Consideration of Requests for Direction Signs in
Public Rights-of-Way, is hereby amended to read as follows:
"H. Penalty
A person who violates any of the provisions of this section is subject to a fine
~ursuant to the General Penalty set out in Chapter 1, Section 5, of this Code of
rdinances."

That Chapter 1, Section 25.E, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Failure to Return Ubrary Materials, is hereby amended to read as
follows:
"E.
Any person who violates any section of this ordinance is guilty of an offense and
upon convictio.n, is punish.able by a fine pursuant to the General Penalty set out in
Chapter 1, Section 5 of th~s Code of Ordinances."
13.
That Chapter 1, Section 29.D, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Cemetery Rules and Regulations, is hereby amended to read as
follows:
"D. Ooen Hours
The Cemetery shall be open Monday through Saturday from 8:00 AM to sun-
down, and Sunday from 6:00 AM to sundown. A violation of this section shall
constitute a misdemeanor and upon conviction thereof shall be punishable by a
fine pursuant to the General Penalty set out in Chapter 1, Section 5, of this Code
of Ordinances."

That Chapter 2, Section 2.C(4), of the Code of Ordinances of the City of College Station,
Texas, pertaining to Animals and Fowl, is hereby amended to read as follows:
"(4)
Violation of the above sections shall constitute a misdemeanor and upon
conviction thereof shall be punishable by a fine pursuant to the General
Penalty sat out in Chapter 1, Section 5, of this Code of Ordinances."
15.
That Chapter 3, Section 2.T, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Mobile Home Parks, is hereby amended to read as follows:
"T. PenaEies
Any person who violates any provision of this section shall, upon conviction, be
punished by a fine pursuant to the General Penalty sat out in Chapter 1, Section
5, of this Code of Ordinances."

That Chapter 3, Section 3.Q(2), of the Code of Ordinances of the City of College
Station, Texas, pertaining to Development of Streets, is hereby amended to read as
follows:

"(2)
Penalty for Violation
Any person who violates or fails to comply with the requirements of this
section shall be guilty of a misdemeanor and shall be liable to a fine pur-
suant to the General Penalty sat out in Chapter 1, Section 5, of this Code
of Ordinances. Nothing herein contained shall prevent the City from
taking such other lawful action as may be necessary to prevent or remedy
any violation."
17.
That Chapter 3, Section 5.C, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Property Maintenance Regulations, is hereby amended to read as
follows:
"C. Penalty
In the event the Board's order has not been complied with, the Board may autho-
rize the Building Official to file a complaint in the Municipal Court. In the event
that the Municipal Court datermines that there has been a violation of th~s ordi-
nance, including administrative orders of the Board, it shall be authorized to
impose a fine pursuant to the General Penalty sat out in Chapter 1, Section 5, of
this Code of Ordinances."
18.
That Chapter 4, Section 1.E(12), of the Cod.? of Ordinances of the City of College
Station, Texas, pertaining to Solicitors, Charitable Solicitors, Itinerant Vendors, and
Handbill Distributors, is hereby amended to read as follows:
"(12)
A violation of this Section is a Class C misdemeanor and shall be pun-
ished by a fine pursuant to the General Penalty set out in Chapter 1,
Section 5, of this Code of Ordinances."
19.
That Chapter 4, Section 2, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Vending Machines, is hereby amended by adding a Section B to
read as follows:
"a.
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances."
20.
That Chapter 4, Section 3. M(b), of the Code of Ordinances of the City of College
Station, Texas, pertaining to Parades and Motorcades, is hereby amended to read as
follows:

An.y. person, firm, or corporation violating any of the provisions of this
ordinance shall be fined pursuant to the General Penalty set out in Chap-
ter 1, Section 5, of this Code of Ordinances."
21.
That Chapter 4, Section 4.L(1), of the Code of Ordinances of the City of College Station,
Texas, pertaining to Carnivals, Circuses, Menageries, Sideshows, Concessions and
Special Events, is hereby amended to read as follows:
"L PenaEias
(1)
Any person, firm or corporation violating any of the provisions of this ordi-
nance shall be fined pursuant to the General Penalty set out in Chapter 1,
Section 5 of this Code of Ordinances."

That Chapter 4, Section 5.C, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Garage Sales, is hereby amended to read as follows:
"C. Penalty for ViolatiQns
A violation of the provisions of this section shall be deemed a misdemeanor and,
upon conviction thereof., the violator shall be subject to a fine pursuant to the
General Penalty sat out ~n Chapter 1, Section 5, of this Code of Ordinances."
23.
That Chapter 4, Section 7, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Ambulances, is hereby amended by adding a Section K to read as
follows:
"K. Penalty
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pu.rsuant to the General Penalty sat out in
Chapter 1, Section 5, of th~s Code of Ordinances."
24.
That Chapter 4, Section 8, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Alarm Systems, ~s hereby amended by adding a Section J to read
as follows:
"J. Penalty
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances."

That Chapter 4, Section 10(M), of the Code of Ordinances of the City of College Station,
Texas, pertaining to Wrecker Bus~ness Regulations, is hereby amended to read as
follows:
"M. Penalty for Violation
Any person who violates any provision of this section is guilty of a misdemeanor
and upon conviction thereof shall be .p. unishable, by a fine pursuant to the
General Penalty sat out in Chapter 1, Section 5, of th~s Code of Ordinances."
That Chapter 4, Section 11, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Moving Houses or Other Buildings Across City Streats, is hereby
amended by adding a Section D to read as follows:
"D. Penaitv
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances."
That Chapter 4, Section 12.K(1), of the Code of Ordinances of the City of College
Station, Texas, pertaining to Fair Housing Regulations, is hereby amended to read as
follows:
Any p,e. rson, firm or corporation violating any provision of this section shall
be guilty of a misdemeanor, and upon conviction .s. hall be fined pursuant
to the General Penalty sat out in Chapter 1, SectIon 5, of this Code of
Ordinances. Each day a violation continues after passage of seventy-five
(75) days from the date of the filing of the initial complaint with the City
Attorney shall constitute a separate and distinct offense."
28.
That Chapter 4, Section 13.S(2), of the Code of Ordinances of the City of College
Station, Texas, pertaining to Oil and Gas Regulations, is hereby amended to read as
follows:
Any violation of this Ordinance shall be punished by a fine pursuant to the
General Penalty set out in Chapter 1, Section 5, of this Code of
Ordinances, subject to applicable ;State law."

That Chapter 4, Section 14, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Badges, Uniforms, and Identification of Vehicles, is hereby
amended by adding a Section C to read as follows:
"C.
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances."
30.
That Chapter 4, Section 15, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Purchases and Sales of Used Goods, is hereby amended by
adding a Section H to read as follows:
"H. Penalty
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances."
31.
That Chapter 4, Section 16.F(4), of the Code of Ordinances of the City of College
Station, Texas, pertaining to Opening and Closing Graves, is hereby amended to read
as follows:
"(4)
Any wolation of the terms of this ordinance is e Class C misdemeanor
offense, and ~s punishable upon conviction by a fine pursuant to the
General Penalty set out in Chapter 1, Section 5, of this Code of Ordi-
nances.''
That Chapter 4, Section 17.K(4) of the Code of Ordinances of the City of College
Station, Texas, pertaining to Sexually Oriented Commercial Activities, is hereby
amended to read as follows:
"(4)
Violation Deemed a Misdemeanor
Where authorized by law, the violation of any provision of these regula-
tions will be considered a misdemeanor and upon conviction thereof shall
bepunishable by a fine pursuant to the General Penalty set out in Chapter
1, Section 5, of this Code of Ordinances."
That Chapter 6, Section 1.B.(3)602.6.16, of the Code of Ordinances of the City of
College Station, Texas, pertaining to Fire Prevention Code, is hereby amended to read
as follows:

"(3)
602.6.16 Penalties
Any person who shall violate any of the provisions of the Code hereby
adopted or fail to comply herewith, or who shall violate or fail to comply
with any order made thereunder, or who shall build in violation of any
detailed statement of specification or. plans submitted and approved
thereunder, or any certificate or permit ~ssued thereunder, and from which
no appeal has been taken, or who shall fail to comply with such an order
as affirmed or modified by the City of College Station, shall severally for
each and every violation and noncompliance respectively be guilty of a
misdemeanor. Any violation of this ordinance is punishable by a fine
pursuant to the General Penalty set out in Chapter 1, Section 5, of this
Code of Ordinances. The imposition of one (1) penalty for any violation
shall not excuse the violation or permit it to correct or remedy such viola-
tions or defects within a reasonable time; and when not otherwise speci-
fied, each ten (10) days that prohibited conditions are maintained shall
constitute a separate offense. The applications of the above penalty shall
not be held to prevent the enforced removal of prohibited conditions."
That Chapter 6, Section 1.B(4)(e)603.17.12 Penalty, of the Code of Ordinances of the
City of College Station, Texas, pertaining to Building Numbering, is hereby amended to
read as follows:
"(e)
603.17.12 Penalty
Any person failing or refusing to put the proper number on premises, a
building or sub-unit, or placing the wrong number thereon, or failing or
refusing to comply with any other requirement of this ordinance shall be
deemed guilty of a ClassC misdemeanor for which punishment shall be
¢~ursuant to the General Penalty set out in Chapter 1, Section 5, of this
ode of Ordinancas."
35.
That Chapter 6, Section 3.E, of the Code of Ordinances of the City of College Station,
Texas, pertaining to the Fire Marshall, is hereby amended to read as follows:
"E. Unlawful to Disobey Any Lawful Order of Fire Marshal
Any witness who refuses to be sworn, or who refuses to appear to testify, or who
disobeys any lawful order of said Fire Marshal, or who fails or refuses to produce
any book, paper, or document touching any matter under examination, or who is
guilty of any contemptuous conduct during any of the proceedings of the Fire
Marshal ~n the matter of said investigation or inquiry, after being summonsed to
give testimony in relation to any matter under investigation as aforesaid, shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be punish-
able by a fine pursuant to the General Penalty sat out in Chapter 1, Section 5, of

this Code of Ordinances; and it shall be the duty of the Fire Marshal to cause all
such offenders to be prosecuted. Provided, however, that any person so con-
victed shall have the right of appeal.
That Chapter 7, Section 1, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Stagnant Water, Trash, and Grass, is hereby amended by adding a
Section F to read as follows:
"F. Penalty
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a line pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances."
37.
That Chapter 7, Section 4.F, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Litter Control on Public Property, is hereby amended to read as
follows:
"F.
A person who violates any of the provisions of this section is subject to a line
pursuant to the General Penalty set out in Chapter 1, Section 5, of this Code of
Ordinances."
That Chapter 7, Section 7.C, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Sale of Unpasteurized Milk or Milk Products Prohibited, is hereby
amended to read as follows:

A person who violates any of the provisions of this section is subject to a line
~lursuant to the General Penalty set out in Chapter 1, Section 5, of this Code of
rdinances."
39.
That Chapter 7, Section 9, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Smoking of Tobacco Products in Public Places, is hereby amended
by adding a Section F to read as follows:
"F. Penalty
A violation of this section shall constitute a misdemeanor and upon conwction
thereof shall be punishable by a line pursuant to the General Penalty set out in
Chapter 1, Section 5, of this Code of Ordinances."

That Chapter 8, Section 8.C, of the Code of Ordinances of the City of College Station,
Texas, pertaining to the Emergency Management Plan, is hereby amended to read as
follows:
"C. Penalty Provisions
It shall be a violation of this section for any person to wear or display in any man-
ner any insignia, sign, or device purported to be for a volunteer except when the
insignia has been duly issued by the office of the Mayor and is displayed in
accordance with regulations established by the City Manager. It shall be unlawful
for any person to give or cause to be given a false alarm of attack. Tampering
with or damaging warning systems or equipment by any means whatsoever shall
be considered a violation of this ordinance. Any violation of Sections 4 through 8
of this Ordinance shall be punishable by a fine not to exceed $1,000.00 or con-
finement in jail for a term not to exceed 180 days, or both, upon conwction
thereof, and each offense shall be deemed to be a separate violation and pun-
ishable as a separate offense."

That Chapter 9, Section 15.A, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Subdivisions, is hereby amended to read as follows:
"15-A.
Within Coroorate Limits
Any person violating any provision of this chapter, within the corporate
limits of the City of College Station, shall be guilty of a m~sdemeanor, and
upon conviction, shall be fined pursuant to the General Penalty sat out in
Chapter 1, Section 5, of this Code of Ordinances. Prosecution or convic-
tion under this provision shall never be a bar to any other relief for viola-
tions of this chapter."
That Chapter 10, Section 2.G(2), of the Code of Ordinances of the City of College
Station, Texas, pertaining to Bikeways and Bike Prohibitions, is hereby amended to
read as follows:
Any person who travels on a bicycle on any street prohibited under Sub-
section G (1) above shall be subject to a fine pursuant to the General
Penalty set out in Chapter 1, Section 5, of this Code of Ordinances."
43.
That Chapter 10, Section 4. C, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Parking, is hereby amended to read as follows:

"C. Enforcement
It is therefore ordered and ordained that the proper authorities be instructed to
enforce parking regulations established by the City Manager's office and that
anyone violating said regulations be found guilty of a misdemeanor pursuant to
the General Penalty se{ out in Chapter 1, Section 5, of this Code of Ordinances."
44.
That Chapter 10, Section 5.L, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Junked Motor Vehicle Regulations, ~s hereby amended to read as
follows:
"L. Penalty
Anyone violating this ordinance shall be guilty of a misdemeanor and upon con-
viction shall be lined pursuant to the General Penalty set out ~n Chapter 1,
Section 5, of this Code of Ordinances."
45.
That Chapter 10, Section 6, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Parking, Standing, or Storing of Recreational Vehicles, Trailers, or
Trucks in Residential Areas, is hereby amended by adding a Section D to read as
follows:
"D. Penalty
A wolation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty set out in
Chapter 1, Section 5, of this Code of Ordinances."
46.
That Chapter 11, Section I.K, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Utility Deposit Requirements and Connection Fees, is hereby
amended to read as follows:
"K. Penalty
Any person, firm, or corporation who shall manipulate or cause the manipulation
of any part whatsoever of the electrical and/water distribution system of the City
of College Station, for the purpose of connecting to sa~d distribution system to
obtain electric current and/or water without the knowledge of the City of College
Station, and in violation of the prowsions of this section, shall upon conviction
thereof be fined pursuant to the General Penalty set out in Chapter 1, Section 5,
of this Code of Ordinances."

That Chapter 11, Section 2, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Water and Sewer Services, is hereby amended by adding a Section
I to read as follows:
"1. Penalty
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty set out in
Chapter 1, Section 5, of this Code of Ordinances."
48.
That Chapter .11, Section 4, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Electrical Service, is hereby amended by adding a Section G to
read as follows:
"G. Penalty
A violation of this section shall constitute a misdemeanor and upon conviction
thereof shall be punishable by a fine pursuant to the General Penalty sat out in
Chapter 1, Section 5 of this Code of Ordinances."
49.
That Chapter 11, Section 6.J, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Industrial Waste Regulations, is hereby amended to read as
follows:
"J. Penalty
Any person violating any provision of this section upon conviction shall be fined
pursuant to the General Penalty set out ~n Chapter 1, Section 5, of this Code of
Ordinances."
50.
That Chapter 13, Section 7.C, of the Code of Ordinances of the City of College Station,
Texas, pertaining to Flood Hazard Protection, is hereby amended to read as follows:
"C. Penaltv lmoosed
Upon the finding of a violation of this ordinance, the Administrator may file a
complaint in the Municipal Court of the City of College Station against any per-
son, firm, corporation, or other legal entn'y, in the event that the judge finds any
person, firm, corporet~on, or other legal entity to be in violation of the terms, con-
ditions, or requirements of this chapter, or provisions or conditions pursuant
thereto, he shall find said person firm, corporation, or other legal entity guilty of a
misdemeanor; and upon conviction shall impose a fine pursuant to the General

Penalty set out in Chapter 1, Section 5, of this Code of Ordinances. Prosecution
under this provision shall not be a bar to any other relief for violation of this
chapter."
51.
And, it ~s ordained that this ordinance shall become effective from and after its
passage in accordance with the City Charter of the City of College Station.
