AN ORDINANCE OF THE CITY OF COLLEGE STATION, TEXAS, ESTABLISHING A
MUNICIPAL COURT BUILDING SECURITY FUND; PROVIDING FOR THE
ASSESSMENT AND COLLECTION OF A MUNICIPAL COURT BUILDING SECURITY
FEE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EXPIRATION DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, THAT:
PART 1: There is hereby created and established a Municipal Court Building Security Fund
(hereinafter known as "the Fund"), pursuant to Article 102.017 of the CODE OF
CPmvtINAL PROCEDURE. The Fund may be maintained in an interest-beating,
general revenue account.
A fee of Three Dollars ($3.00) shall be assessed and collected as a cost of court
from each defendant upon conviction in the Municipal Court for a misdemeanor
offense committed on or after November 1, 1999. Each defendant is considered
convicted if a sentence is imposed on the defendant; the defendant is placed on
community supervision, including deferred adjudication; or the court defers final
disposition of the defendant's case. The clerk of the court shall collect the fee and
pay the fee to the Director of Fiscal Services of the City of College Station, or his
delegate, who shall deposit the fee into the Municipal Court Building Security
Fund.
The Fund shall be used only to finance the purchase of security services and
devices for the Municipal Court building of the City of College Station, including:
the purchase or repair of X-ray machines and conveying systems; hand-held metal
detectors; walk-through metal detectors; identification cards and systems;
electronic locking and surveillance equipment; bailiffs, deputy sheriffs, deputy
equipment, contract security personnel deputy constables, or providing appropriate
security services; confiscated weapon inventory and tracking systems; locks,
chains, or other security hardware; or continuing education on security issues for
court personnel and security personnel. The Fund shall be administered by or
under the direction of the City Council of the City of College Station.

If any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holdings shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
All ordinances and parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of conflict with this ordinance.
This Ordinance becomes effective immediately upon passage by the City Council.
