A.I That there are special circumstances or conditions affecting the land involved such that strict application of the provisions of this chapter will deprive the applicant of the reasonable use of his land; The special circumstance for this subdivision is that the street frontage where the sidewalk is required is Earl Rudder Freeway. There are no sidewalks on Earl Rudder Freeway. It is doubtful that TxDOT would allow the construction of sidewalks in the right-of-way of this freeway. A.2 That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant; In order to develop the Subdivision as planned this variance is necessary. A.3 That the granting of the variance will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this chapter; Granting this variance should not have any effect on the public health,safety,or welfare, or injurious to other property in the area since pedestrians should not be encouraged to be near the freeway because of the danger of walking in this area. Granting this variance would actually enhance the health and safety of the public. A.4 That the granting of the variance will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter. All of the surrounding land is developed. Please include the property owner on the application. This property owner must also be reflected in the Ownership & Dedication certificate on the plat and in the title block of the plat. Response: Since a tax certificate for the current owner does not yet exist (no taxes have been required to be paid to date by the new owner), then we are submitting a copy of the deed to show the current owner. The title block should read "Final Plat of Lots 2B-1, 2B-2, and 2B-3 Horse Haven Estates Subdivision,being a Replat of Lot 2B Horse Haven Estates Subdivision. Response: Title block has been corrected. /The original plat should be to scale. Response: The original plat is now shown to scale. /Note 2 states that the property is currently zoned A-O Agricultural-Open. The property is actually zoned C-1 General Commercial. Response: Note has been revised. Note 3 is incomplete;please complete it or remove it. Response: Note has been removed. c„ZPlease change the ownership and dedication certificate to reflect what is shown in the Subdivision Regulations(ie: don't include a vol. And page for when the property was transferred). Response: Ownership information revised as requested. Why has the note regarding building plot not been carried over from the original plan? Response: Note has been added. /Switch Station is not currently a right-of-way, as shown on your replat. Response: ROW designation has been removed. FYI— Switch Station is not currently improved to a level where development or the public may access this roadway. Response: Noted. )),eSidewalks are required on roadways in excess of 50 feet of right-of-way. If you do not wish to provide sidewalks,please submit a variance request. Response: A variance request is being submitted with this resubmittal. 0 11. Please note that any changes made to the plans, that have not been requested by the City of College Station, must be explained in your next transmittal letter and "bubbled"on your plans. Any additional changes on these plans that the City has not been made aware of will constitute a completely new review. Response: Noted. TxDOT Comments have been noted. Engineering Comments 1. As you know, the minimum sewer grades are based on minimum velocities flowing full. Several of subject lines are depicted with there estimated ultimate flows as they will not be extended; however, the associated velocities do not achieve the local or state minimum flushing velocities of 2.5 fps or 2.0 fps, respectively. Grades on this project appear adequate to achieve more desirable velocities. Please revise accordingly. Response: We disagree with your assessment that grades appear to be adequate. If we change to 6" lines and use a minimum grade of 0.80 %, the flowline of Manhole #3 will be 264.09. If we assume that a building will be positioned near the center of Lot 2B-3, the service line that must extend to the approximate center of the lot will be about 165 feet long. If the service line is laid at the minimum grade of 1%, the flowline at the building will be 265.74. The ground elevation at the center of Lot 2B- 3 is about 266.50 feet, so the service line will be 0.76 ft. deep. That is less than allowed in the Vertical Layout Section of the Design Guidelines, and could greatly limit the potential use of Lot 2B-3. Therefore, we believe the use of the 8" line as shown on the plans is the best design for this situation. 2. As site development occurs on each of these 3 lots, drainage reports will need to be submitted to address the conditions and constraints set forth with the Gander Mountain drainage report and associated drainage improvements. Response: Noted. 3. Storm water management requirements are as follows, any questions may be directed to Donnie Willis,CoCS Drainage Inspector, at 979-764-6375.
