The ROW to be abandoned is approximately a 1390'section abutting F&B Road. This leaves approximately a 1790'section
between the abandonment and the City Limits. Electric and storm culvert near F&B appear to be the only infrastructure.

Dear Bruce:
As we have discussed, the City of College Station's review the TAMUS application to abandon a
portion of the subject Right-of-Way, concluded that a Public Utility Easement dedication to the
City is necessary. This dedication should mirror the metes and bounds of the proposed Right-of-
Way abandonment and should be provided prior to the abandonment being placed on the City
Council agenda.
This letter is to serve as the written request for TAMUS to submit the subject easement
agreement documentation to the City. Attached please find the City's standard Easement
Dedication Sheet Application for your use.

There are a handful of comments I wanted to get back with you on regarding the abandonment:
1. We spoke briefly regarding the City retaining a PUE from the abandonment. TAMUS dedicated the ROW to the County
originally in 1966 in V257 P311. In my reading of it this document,only roadway rights were granted. So it would appear
the City would need a PUE(ideally for the entire ROW boundary that is being abandoned)to be dedicated before this
abandonment item is placed on the Council agenda for formal action.
2. We've noticed traveling southbound on Finfeather the contractor installed a reduced lane sign that is covered by tree
limbs heading toward Agronomy.They did not remove the white dashed lane markings going to a single lane.This is a
hazardous condition that needs to be corrected by the contractor ASAP since these items were part of the project.
3. With regard to the naming of the roadway, we would suggest the TAMU portion of the roadway extension should
remain Agronomy up to the old section of Finfeather.
The City can install the city street name signs midblock as Finfeather transitions into the reverse curve of Agronomy.
4. It appears that TAMU has replaced/installed all necessary signs in this area including stop signs. Since the beacon is
flashing red for the abandon portion of Finfeather which is no longer a roadway but a driveway,so we did ahead and
remove the beacon.
5. Within the subject ROW to be abandoned,there are spoil piles from the street construction that may need to removed
(if in the subject ROW),and the disturbed areas should be seeded/vegetated.
6. Please provide a letter from TAMU stating that the new roadway is publicly owned and operated by TAMU,and is open
for the use of public ingress and egress.
7. Please secure a signature from BTU on exhibit#3 as they have now been added to the application.

Alan,
I have an interesting question that never did get answered. If A&M is
to maintain the new Agronomy Road extension at the new pavement,then is
it Finfeather or Agronomy? Would the road name change at F&B stop sign
from Agronomy to Finfeather??
Just scratching my head on this one

Alan-I reviewed these documents and found the following:
/1. The ordinance will need to be on the newly revised form(you indicated you will do this).
2. The ordinance will need to include language excepting out a pue(which Mark indicated we will need to retain).
3. The abandonment must be contingent on the completion and opening of the new route to the public.
4. The application needs to be reviewed and signed by all city staff listed on the application form.
5. Does the city own the ROW in fee or is it an easement? We need to know what entity is the applicant property owner of
the fee or abutting property. i.e.Is it TAMU or TAMUS?

Dear Mr.Brown:
You recently requested, by letter dated September 27, 2005, that the County
execute a consent to the abandonment of a portion of Finfeather Road. This request was
made as your records reflect that Texas A&M University had, at some time in the past,
conveyed an easement to Brazos County, Texas for the construction of Finfeather Road.
However, it is the County's understanding that Finfeather Road was annexed by the City
of College Station some years ago. As a result of this annexation, Brazos County, Texas
has no interest in the Finfeather easement to be abandoned. Premised thereon, the County
sees no need to execute a consent as requested.

Seem like I remember someone telling me that this part of the new roadway would be TAMU's road but
would allow for public use. Is this not the case?

Are they dedicating ROW for the realignment??
We should not abandon one roadway until the new one is in place. It is still a public right-of-way that is still
in use by the public. The City Engineer should not sign off on the abandonment until the new street is in
place.
Also, we should not do a"conditional" abandonment with such a large condition as dedicating ROW and
building a new roadway.

Alan said this morning that the Finfeather abandonment was being circulated for signatures and should be
on the January 26th Agenda. I gave Alan the$300 check for the abandonment application. The question
came up about the new ordinance change requiring an appraisal and value received for the land. I
assume that no one wants to go there.
There was one issue in that Tony wanted and electrical easement.
There are no water or sewer along the portion of Finfeather proposed to be abandoned. There is a COCS
water line along F&B. It was constructed by CSU with design by Malcolm Pirnie. John thought it was in a
COCS easement. The GIS map indicates only a small portion on the east side of F&B as having a COCS
easement. John was going to check Pirnie's plans to see if it is in the easement. This could be an issue
with F&B going back to TAMU.

According to Brad Brown with Klotz, the abandonment of Finfeather will not affect the existing utility
easements.

Oh my gosh! I'm really shocked by this, it's not what I expected. Alan, I've left a message with Brenda in
Legal to see if we can modify the application (since it's their application). If not, we'll need to get the
changes to them to make so we can upload it to the web and swap out the old ones in our office as soon
as possible. If you haven't set up a meeting with Mark yet to meet with staff on this issue, how about if we
have him come to our staff meeting on Wednesday morning at 9:00 to discuss the changes?

1) The ordinance is in effect now. Applications that were submitted prior to the ordinance being passed in
November are not affected by the new ordinance(ie christine lane)
2) The application has not been modified but that shouldn't be a very difficult task. I think Alan can handle
it. Just track the ordinance.
3) It affects all easements and ROWs regardless of how the City obtained them. The easements and/or
ROWs arereal property rights that belong to the taxpayers and the local government code says that we
may not give them away and must get"fair market value"for them. The LGC does provide an exemption
that allows us to give these property rights away to an institution of higher learning for certain purposes.
4) The requirement applies to all eaement and ROW intrests that the City owns. I suppose there may be
a rare case where the City and not the County would own the easement or ROW but I can't think of any
right off hand. If it is a PUE or a ROW and it is not in the City Limits it belongs to the County. There may
be some utility specific easements for CSU that are outside the City Limits and I am guessing that the
rules would apply to those.

Good afternoon! Alan mentioned that this ordinance was approved back in November and I had some
questions for him that he was unsure of. He asked me to send the questions to you for the future meeting
that he said he would set up with you and staff. Let me know if you need clarification on any of the
questions. I'm sure more questions will arise in the meeting. Thank you!
1)When does this take affect?
2) If it takes affect now, has the application been modified to include the new requirements? If so, can you
send me a copy so that we can replace all of our old applications and upload the new one to our web site.
3) Does this include all easements/ROWs or just easements/ROWs that the City paid for originally?
4) Does this requirement change in the ETJ?

Charles has indicated the proposed transition from the Finfeather ROW to Agronomy(State driveway) has
not been determined to date. Tony has said he needs an existing PUE saved and excepted along the
current Finfeather alignment and provisions for additional street light(s) at this transition may be
necessary. Additionally, F&B from Wellborn to 2818 is recognized as State drive, so we may need to
determine if other easements along F&B are needed - I see we have a waterline there.

We will need easements in the area that is going to be abandoned (Do we have to abandon it or can we
keep it for future utility routes?). We have an existing line in ROW and plan on adding some more when
the substation goes in.
We would like to discuss possible easements along Agronomy for future Power line routes.
Is Agronomy going to be a City Street? If so will there be street lighting installed (we need to sure is
meets the City St light standards)?
