Subject: New amenities plan to be turned in today
Hi Jennifer:
The board met with Todd last Tuesday and we redesigned the plan to fit what space we have left. Todd is
suppose to turn this new concept plan into the city today. I will check with you tomorrow and see if it actually
happened. The pool will be approx. 25ft by 55ft with 8ft decking around. It also has a 10 by 12ft gazebo area.
Todd has agree to put a stainless steel stationary outside grill (charcoal type) near the amenities area for
everyone to use. There will also be a pool shed for storage of pool furniture and equiptment for off season
use. All the officers and board of directors are in agreement with this new concept plan. I realize the city still has
to approve it, but we would like to see this version go thru so we can start getting bids and move forward. Any
suggestions would be greatly appreciated

The purpose of this letter is to respectfully request that our
Committee be advised of and a member permitted to attend those
DRB meetings where issues relating to the Harvey Hillsides
Addition are addressed. It is understood our "status" would
be that of an "observer. "
Of recent interest are activities concerning the completion
of Heritage Townhomes/T.C. Homes/Hausman Interests Townhomes,
Ltd. and their impact in Lot 18, Block 2 (and possibly Lot 16,
Block 2 ) of our Addition.
Heritage Townhomes, along with other properties along Harvey
Road/Texas Highway 30, are a part (Block 4 ) of the Harvey
Hillsides Addition. Our Covenants and Restrictions specify
certain standards to protect the health, welfare, quality-of-
life, and property values of our residents and property owners .

Dear Ms. Michael:
Our Committee has been advised of your proposed improvements
at the Heritage Townhomes.
Since Heritage Townhomes is part (Block 4) of the Harvey
Hillsides Addition (in addition to being within the College
Station city limits) it is subject to our Covenants and
Restrictions. (Todd Carnes has a copy of this document; I can
provide you an additional copy if needed. )
As your plans materialize in fulfillment of the Planned
Development District (PDD) we ask that you provide us copies
for review. Usually our requirements coincide closely with
those of College Station. We place emphasis on the protection
of our residents ' and landowners' health, welfare, quality of
life, and property values. In the case of the Heritage
Townhomes, we shall be looking closely at any adverse impact
on Lot 18 of Block 2 (and possibly Lot 16 of Block 2) and the
creek which runs between these lots and the townhomes.
We look forward to the successful completion of your project.

Dear Jennifer:
I wanted to thank you for getting the staff members together for our meeting on Friday,
June 23,2006. Your information was very helpful for our concerns with the completion
of the Heritage Townhomes project.
Please be advised that ll the homeowners at Heritage want the original amenities that are
on the original rte ill-KAdated 11/28/2000,ordinance#2482. These amenities include the rc.,. �� 1-- (L
pool, gazebo,walking path,and playground mce these amenities appear on tis-site t cr.
{ h -and conceptual plan,it is my understanding that the concept plan is part of the
ordinance and therefore must be included somewhere on the property. We have been told
on June 15th,2006 that there is no room for all these amenities. This has caused great
concerns since people have bought/invested in the home as well as future amenities that
where promised to be built. We have just recently formed a board and officers and for the
past 3months have been trying to compile information with regards to the Heritage
Townhome's project. You have informed me that the most recent communications with
Todd Carnes have resulted in him telling you the homeowners do nota all the
amenities. This is definitely NOT the case. Please pass this information along to the
Design/Review Board so they are aware of what the homeowners want.
I also have been informed by your committee that the request for the removal of the PUE(Ii*a NAV n n'k+•A 444
was turned in on Friday morning(6/23/06). Please let me know if this request has any
issues with any of the city offices that it must go through for approval. We need to get
this to the City Council meeting on Aug. 24', 2006. It is also my understanding that
Todd Carnes was given some latitude with regards to street width and relief from eertairr-1_�: k se5 S
eases-during the development of this project,all of which is appropriate if he kept all
the original amenities and areas that are to have brick walls and wrought iron fencing
intact. It is apparent that Todd has used up the common areas with the above requests,
therefore making the amenities a big issue. I would respectfully request that the city not
favor any modifications or omissions of any of the amenities that are on the original site
and conceptual plan which are part of the ordinance#2482.
I also understand that the city does not recommend building in the flood plain and there
can't be any disturbance in the detention pond areas that could impede flow. It is obvious
to me after meeting with your group that Todd Carnes will have to put the amenities
where there are some existing lots with no homes currently on them to fulfill his original
commitment to this project. I appreciate all your help and assistance. Please keep me
