GENERAL VARIANCE REQUEST The following specific variation from the ordinance is requested: A variance is requested to reconstruct a storage building that was originally built in 1961 on a slab foundation that encroaches on the side building setback by 11 inches between Lot 12 and Lot 13 and by 10 inches on the setback allowance from Williams Street. See survey attached. This variance is necessary due to the following special conditions: Special Condition Definition: To justify a variance, the difficulty must be due to unique circumstances involving the particular property. The unique circumstances must be related to a physical characteristic of the property itself, not to the owner's personal situation. This is because regardless of ownership, the variance will run with the land. Example: A creek bisecting a lot, a smaller buildable area than is seen on surrounding lots, specimen trees. Note: A cul-de-sac is a standard street layout in College Station. The shape of standard cul-de-sac lots are generally not special conditions. The storage building was built prior to the enactment of the Uniform Development Code adopted on September 23. 2004. The intended use of the reconstructed storage building remains the same. On Monday. September 19. in consideration of the high winds projected to hit the Brazos Valley as a result of Hurricane Rita. the walls and roof were dismantled. Due to the potential hazards these loose materials could pose in hurricane winds, City Services removed the loose materials on Thursday. September 22 at the request of property owner. Property owner requests a variance to reconstruct storage building on existing slab. The reconstructed structure will meet building codes and will be safer and more secure than the previous structure. As recent as last week, a student of College Hills Elementary wandered off campus unnoticed highlighting the importance of reconstructing a safer, more secure storage building. See attached picture of previous structure. The unnecessary hardship (s) involved by meeting the provisions of the ordinance other than financial hardship is/are: Hardship Definition: The inability to make reasonable use of the property in accord with the literal requirements of the law. The hardship must be a direct result of the special condition. Example: A hardship of a creek bisecting a lot could be the reduction of the buildable area on the lot, when compared to neighboring properties. Hurricane force winds were projected to hit the Brazos Valley the weekend of September 24. To provide for the safety of the neighboring citizens, school and homes. property owner determined that time only allowed for dismantling rather than repairing the structure. The variance is needed to reconstruct the structure on existing foundation for continued use as a storage building. Property owner places great importance on reconstructing a safe, secure storage building due to close proximity to College Hills Elementary. The following alternatives to the ryuested variance are possible: Although a portable building would be allowed in the exact location, it would be not be as structurally sound, nor as aesthetic as the proposed structure. This variance will not be contrary to the public interest by virtue of the following facts: A storage structure was in the exact location since 1961 with no known negative impacts to public interest. It should also be noted that all the lots that adjoin Williams Street are approximately 1 to 1.5 acres in size with houses facing Walton Drive. As such,the nearest home (Lot 13, Block 8) is more than 200 feet from the storage building.
