Box 9960 College Station, Texas 77842 RE: Proposed Office Building @ Sebesta Road Joey, On Tuesday October 18th, I was in a facilitation meeting with Alan Gibbs, Bridgette George, Molly Hitchcock and Crissy Hartl. The meeting was to review a site plan for a proposed office building on Sebesta Road. I took the time in earlier, non-formal, meetings to ask questions regarding could the site be approved for an office building. A number of questions were asked including the use of an existing septic system for two office buildings. The Brazos County Health Department has approved the use for both office buildings to use the same septic system. I have proposed installing a new aerobic system and, with a chlorinator, we will water the grass areas. Lot 1, Block 2 of CSL of Texas are both on septic systems as well as lot1, Block 1, TJ Addition. In 1991, when I built the office building at the corner of Sebesta & Earl Rudder access, I negotiated with the City of College Station to give a 10' R.O.W. easement for Sebesta Road to be widened and utilities brought to the access road. Sometime later, the Coca Cola Distributorship built a building on Sebesta Road east of my two lots. They brought the sewer from Frost Drive and Sebesta to their new building. Coca Cola gave the City of College Station, in escrow, approximately $30,000 to bring the sewer across their lot to my lot line. The City was to widen Sebesta Road and bring the utilities to Earl Rudder. When Sebesta Road was widened and improved, they only brought the water line. I have already given the City of College Station the 10' R.O.W. for my participation in the sewer line extension. This all happened in 1981. There have been a number of staff and city managers since that time. Elrey Ash, who was the City Engineer, was involved in the negotiation and still lives in College Station. He should be able to verify this history, along with the escrow amount of approximately$30,000 the City has and should be findable. It was found in 1998 when I built the office building at 3205 Earl Rudder. I am giving the history for your review in that I was told in the facilitation meeting they wanted me to bring the sewer to the new building. I would appreciate some time with you and Alan Gibbs to review this matter. Once I had visited with the City staff and felt the new office would be approved, I listed my old office for sale and it sold quickly. It is very important to me to reach a conclusion on the site plan. When an approval is reached, I am buying a small corner of the lot located immediately to the south of my property. I will then have to re-plat my lot and the lot next door, the Orkin Building. Only then can I obtain a building permit to construct my new office building. Page 1 of 2 Sometime in the future, when sewer is brought down Sebesta Road to Earl Rudder, I will re-plat the lot with both office buildings. When there is sewer available, both lots may stand on their own. I hope you understand the chain of events and my intent for now and in the future. Date: 1/19/2006 4:50:24 PM Subject: Re: 1401 Sebesta Building Permit Tony, The November letter was adequate to allow the property to be replatted. However, for Site Plan approval (and subsequent Building Permit issuance)we need approval from the Brazos County Health Department to authorize the building of the septic system. Specifically,their approval is termed an Authorization to Construct(ATC). Don Plitt explains that you would need to have a Site and Soil Evaluation designed and submitted to receive an ATC. We need you to submit the ATC and the Site and Soil Evaluation to the City to know that the proposed Site Plan will "have"sewer and work. I hope this not insurmountable for your timeline. It is my understanding that the building permit is being held up until this letter is given to the City of College Station. I have continually tried to provide all information requested. You asked for a letter from the Health Department stating that it was permissible to put both office buildings on one system. This was provided in November, 2005. I later received a request for another letter being "site specific." I called Don Plitt and asked if he would call you and find out what was needed. I now understand that there is a permit needed before a building permit can be obtained. This was also qualified in Don's first letter that the area must be able to take care of the system. A licensed installer must have the system designed, approved, installed and inspected by the Health Department. In 1998,when the first system was installed, it was designed to provide an adequate septic system that took care of an office with two commodes and three sinks. This designed around the use by seven to 10 people. The system is a submerged system with approximately a 15'x 15'drainage field. We are adding one commode and 2 lavatory's. The system is to be designed as an above ground sprinkler system which will adequately take care of a three bedroom, three bath house. The flow rate is 240 gallons/day on this size of system. There are two sprinkler heads needed on this system which is dispersed over about 30'x 60'area. The system we need will be about 1/4 to 1/3 the size of that system and we will have over 1/2 acre to water. We plan on using smaller sprinklers and using the water to irrigate the grass areas. Having had a lot of experience in installing these type of systems, I knew that we would have more than adequate watering areas. I would not have started this project if I felt it would be questionable. I need to start the building to vacate the current office. I'm asking you for some consideration so that I may obtain a building permit. The system will be the first thing installed so that it can take care of the existing building while under construction on the new building. Box 9960 College Station, Texas 77842 Dear Mr. Norton: I have been requested by Mr. Tony Jones to explain that, by state regulations, (Title 30, TAC, Chapter 285 — On-Site Sewage Facilities) two buildings may be serviced by one septic system, provided that the same person owns the land. This situation is also contingent upon the septic system planner being able to site a legal system on that property. Please also understand that the two buildings would have to be sold together, or two separate systems would have to be installed to facilitate a sale.
