Item: A Rezoning for Higgins Suzuki/Mitsubishi consisting of a 10 acre tract
located on State Highway 6 South bound Frontage Road just adjacent (north) to
Home Depot.
Applicant: Mace Higgins
Staff Recommendations: Staff is recommending denial of the rezoning request
from R-1 Single Family to C-1 General Commercial.
Item Summary: The subject property has approximately 727 feet of frontage
along the south bound access road of State Highway 6 and is currently
undeveloped. The property is bound by the City of Bryan to the north. To the
west is C-1 developed as the Home Depot detention facility and to the south is
C-1 developed as Home Depot and the future Red Lobster site location.
Comprehensive Plan Considerations: The Comprehensive Plan shows the
subject property as Floodplain/Streams and is shown on the FEMA Maps within
the 100-year floodplain. Floodplain/Streams is shown on this entire tract, so staff
recommends the FEMA floodway/floodplain not be rezoned.
Item Background: The subject property was annexed into the City of College
Station city limits in 1971 and is currently not platted. All property annexed in this
time period was brought in as R-1 Single Family.
Commission Action Options: The Commission acts as a recommending body
on the question of rezoning, which will be ultimately decided by City Council.
The Commission options are:
1. Recommend approval of rezoning as submitted;
2. Recommend a less intense zoning classification;
3. Recommend denial;
4. Table indefinitely; or,
5. Defer action to a specified date.

Home Depot project.
Sewer: A sewer main exists along the property boundary.
Streets: Earl Rudder Freeway is classified as a freeway/expressway.
Off-site Easements: It does not appear that any are needed at this
time. Access from Home Depot is an option.
Drainage: Drainage is to Burton Creek.
Flood Plain: The entire site is in the 100-yr floodplain.

Item Summary: The applicant is proposing to rezone a 4.435 acre
portion of a 10-acre tract that will be reclaimed from the floodplain. Of
the remaining acreage, 4.47 acres will retain the R-1 zoning, and
1.08 acres are in the City of Bryan, and zoned C.
Staff Recommendations: Staff recommends approval of the
rezoning as requested based on a positive recommendation
regarding the Land Use Plan amendment request.
The Comprehensive Plan shows this area to be designated as
Floodplain and Streams. The applicant has applied for a
Comprehensive Plan Amendment to amend the plan to Regional
Retail in support of the rezoning request. If the Commission and
Council recommend for, or approve the amendment, this request will
be in compliance with the Comprehensive Plan.
This area is not shown as a priority area on the Greenways Master
Plan.

Item Summary: This item was tabled at the October 6th P&Z Meeting after the
request to amend the Land Use Plan was recommended for denial. On October
24t , the City Council approved the request to amend the Land Use Plan from
Floodplain & Streams to Regional Retail. The applicant is proposing to rezone a
