Applicant: MCCLURE & BROWNE, agent for Davis Young and Paul Clarke. Staff Recommendations: Staff recommends approval of the rezoning. Item Summary: This rezoning request is to include an additional tract of land for the continued single-family residential development in Pebble Creek. The tract lies immediately north of Alum Creek, and a revised preliminary plat will be submitted to incorporate the additional lots into Phases 9D and 9F of Pebble Creek. Comprehensive Plan Considerations: This request is compliance with the Comprehensive Plan. The Land Use Plan element shows this tract for Single-family Low Density (1/3— 3 du/acre). This designation was recently changed through a Comprehensive Plan Amendment process as part of Animate Habitat. Previously, the tract was designated for Single-family Medium Density (4-6 du/acre). Based on the size of the tract (8.542 acres), the gross density allowed is shown in the table below: Low (1/3 du/acre) Medium (1.6625 du/ac) High (3 du/ac) SF Low Density 2.8 du 14.2 du 25.6 du The Floodplain/Streams land use designation is generally applied to the 100- year floodplain as defined by the Federal Emergency Management Agency (FEMA), plus additional areas reserved for open space. Although the Floodplain/ Streams designation conforms to the extent of the 100-year floodplain shown on the Flood Insurance Rate Map, it should be noted that the 230' contour(BFE for this area) extends beyond the mapped floodplain, and for most purposes, land lower than 230' is treated as though it is in the regulatory floodplain. The Thoroughfare Plan element of the Comprehensive Plan shows the planned extension of Pebble Creek Parkway, a major collector, immediately adjacent to this tract. Item Background: The property was annexed in 1996 and has not been platted. Vacant acreage adjacent to this tract and north of Alum Creek was rezoned from A-O to R-1 last fall. Consistent with planning policies, staff recommended approval of the request with the condition that any FEMA-designated floodplain remain A-O. The entire area of the request, inclusive of floodplain, was rezoned R-1. Related Advisory Board Recommendations: None required. Review Criteria: In determining whether to approve, approve with modifications, or disapprove the proposed Official Zoning Map amendment, the City Council shall consider the following matters regarding the proposed amendment: 1. Consistency with the Comprehensive Plan; 2. Compatibility with the present zoning and conforming uses of nearby property and with the character of the neighborhood; 3. Suitability of the property affected by the amendment for uses permitted by the district that would be made applicable by the proposed amendment; 4. Suitability of the property affected by the amendment for uses permitted by the applicable to the property at the time of the proposed amendment; 5. Marketability of the property affected by the amendment for uses permitted by the district applicable to the property at the time of the proposed amendment; and 6. Availability of water, wastewater, stormwater and transportation facilities generally suitable and adequate for the propose use. Commission Action Options: The Commission acts as a recommending body on the question of rezoning, which will be ultimately decided by City Council. The Commission options are: 1. Recommend approval of rezoning as submitted; 2. Recommend denial; 3. Table indefinitely; or, 4. Defer action to a specified date. Supporting Materials: 1. Application 2. Location Map 3. INFRASTRUCTURE AND FACILITIES Water: There is an existing water system in Pebble Creek. The new system for this area is required to meet City guidelines per the Subdivision Regulations. A Water Report is required for the subdivision to ensure compliance. Sewer: There is an existing sewer system in Pebble Creek. A Sewer Report is required for the subdivision to insure capacity and compliance. Streets: The tract is currently landlocked, but will be included in Phases 9D and 9F of Pebble Creek in which lots will ultimately access to St. Andrews Drive, a minor collector. The proposed extension of Pebble Creek Parkway to the south is adjacent to this tract. Off-site Easements: It does not appear that any are needed at this time for utility extensions. Drainage: Drainage is to Alum Creek. Floodplain: Floodplain exists along the southern edge of this tract, with a Base Flood Elevation (BFE) requirement of 230'. Although the mapped floodplain does not encroach on the subject tract, the 230' contour does encroach. Oversize request: To be determined at platting. Impact Fees: None.
