Dear Mr. Standish:
This letter is to verify the allowable use of 415 A Graham Road for the storage
associated with the environmental lab found on the same lot. The property is
zoned M-2 Heavy Industrial, which under the Unified Development Ordinance
(UDO)Article 6.2.C. Use Table, allows for storage.
The UDO became effective June 13, 2003, replacing the previous Zoning
Ordinance. The Zoning Ordinance allowed laboratories (such as the
environmental lab of Energy Laboratories, Inc.) in M-2. The UDO does not allow
laboratories in M-2; therefor, the laboratory that exists on the site is a legally
nonconforming use and may continue as such, but may not expand without
permission from the Zoning Board of Adjustments. Although the storage is an
expansion of the business, storage as a land use is permitted.
This letter is also to inform you that the storage building may not be converted
into laboratory space. To expand the non-conforming use on the site by 25% or
less, permission must be granted from the Zoning Board of Adjustments.
Expansions past 25% of the original area of nonconformity are prohibited.
