TO HAVE AND TO HOLD the same perpetually to the City of College
Station, Texas and its successors, together with the right and
privilege at any and all times to enter said premises, or any part
thereof, for the purpose of constructing, reconstructing, and
maintaining the said sewer line facility on the condition that
the City of College Station, Texas work in connection with the
construction, reconstruction and repairing of said sewer line
facility, restore said premises to the condition in which same
were found before such work was undertaken and that in the use
of said rights and privileges herein granted, the said City of
College Station, Texas and its successors will not create a
nuisance or do any act that will be detrimental to said premises.
An additional easment for construction purposes is granted for
a period of (1) one year from the date hereon, said -construction
easement being a 100 foot wide strip of land and the centerline
of said construction easement following the centerline of said
20 foot sewer line easement .

I, Bert Wheeler , for and in consideration
of the sum of One ($1.00) Dollar, cash to me in hand paid by the
City of College Station, Texas, and other valuable considerations,
receipt of which is acknowledged do hereby give and grant to the
City of College Station, Texas, the right to construct, re-construct,
and perpetually maintain a sanitary sewer upon and across the follow-
ing described property:
Being a strip of land 20 feet wide for a Sanitary Sewer Line easement
situated in the Richard Carter League, Abstract 8, Brazos County,
Texas, and being a part of that 29.95 acre tract of land conveyed to
Bert Wheeler as recorded in Volume 362, Page 117, Brazos County Deed
Records. The centerline of said 20 foot easement being more fully
described as follows:
BEGINNING at a point in the apparent southerly property line of said
Bert Wheeler 29.95 acre tract of land said point also southwesterly
50 feet more or less from the east corner of said tract and the west
right-of-way line of State Highway 6 Bypass and northeasterly 525 •
feet more or less from the south corner of said tract ;
Thence N 55° 13' W 893. 30 feet more or less to an angle point ;
Thence S 71° 32' W 146.40 feet mole or less to a point in a fence line
marking the common property line between Bert Wheeler and the City of
Bryan, Texas said point also being northwesterly 250 feet more or less
from the east corner of a 50 acre tract of land conveyed to the City
of Bryan, Texas as recorded in Volume 133, Page 607 Brazos County
Deed Records and the end of this 20 foot easement .
