SUBJECT: Covenant Presbyterian Church -Conditional Use Permit Site Plan
Staff reviewed the above-mentioned site plan as requested but stopped review due to
an incomplete submittal. The following page is a preliminary list of staff review
comments detailing items that need to be addressed. Please address the comments
and submit the following information by Tuesday, April 25, 12:00 p.m. to be placed on
the next available Planning and Zoning Commission meeting scheduled for May 4,
2000, 7:00 p.m. in the City Hall Council Chambers, 1101 Texas Avenue.

SUBJECT: Conditional Use Permit for Covenant
Church
Item: Public hearing, discussion and possible action on a Conditional Use
Permit (CUP), site plan only, for the Covenant Presbyterian Church located at the
intersection of Rock Prairie Road and Edelweiss Ave. (00-63)
Applicant: Covenant Presbyterian Church
Staff Recommendations: Unless the public hearing brings to light any negative
impacts, staff recommends approval.
Item Summary: The applicant is requesting a modification to the site plan that
was approved for this project last year. The modification is the addition of a berm
at the northwest property corner.
Minor modifications to a conditional use permit site plan are generally approved
at the staff level. Given that a standard berm used for screening purposes would
be 3 feet in height, and that the proposed berm is in a very visible location, is
approximately six feet in height and covers an area of approximately 20,000 sf,
staff considers this to be a significant change to the site plan.
Nonetheless, the berm does not displace any required landscaping or interfere
with any easements. Staff also checked to ensure that it does not block the
required visibility triangle at the intersection of the driveway and Rock Prairie
Road. In fact, the berm will function as additional screening for some of the
church parking. Unless the public hearing brings to light any negative impacts,
staff recommends approval.
Comprehensive Plan Considerations: The Land Use Plan shows Single Family
Residential and Office Use in this area. Religious facilities are allowed in any
zoning district with a Conditional Use Permit granted by the Commission. A use
only, Church Conditional Use Permit, was approved for this property by the
Commission on March 4`h, 1999. The site plan for the CUP was approved by the
Commission on May 18'h, 2000.
Staff Analysis: Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses. The Commission may permit a conditional use subject to

appropriate conditions and safeguards, when after public notice and hearing the
Commission finds that: (Staff comments are in italics)
1. "The proposed use meets all the minimum standards established in the
ordinance for the type of use proposed." Staff conducted a technical review
and found general compliance with development regulations.
2. "That the proposed use meets the purposed and intent of the ordinance and
is in harmony with the development policies and goals and objectives as
embodied in the Comprehensive Plan for Development of the City. The
request is in compliance with the Comprehensive Plan.
3. "That the proposed use will not be detrimental to the health, welfare, and
safety of the surrounding neighborhood or its occupants, nor be substantially
or permanently injurious to neighboring property." The public hearing is an
opportunity for the Commission to measure the potential impact on
surrounding land uses.
The Commission may impose additional reasonable restrictions or conditions to
carry out the spirit and intent of the ordinance and to mitigate adverse effects of
the proposed use. These requirements may include, but are not limited to,
increased open space, loading and parking requirements, additional landscaping,
and additional improvements such as curbing, sidewalks and screening."
Unless the public hearing bring to light any new information indicating potential
negative impacts, Staff recommends approval.
Commission Action Options: The Commission has final authority over the
Conditional Use Permit and associated site plan. The options regarding the use
permit are:
1. Approval as submitted;
2. Approval with conditions relating to specific site
limitations;
3. Denial with specified reasons for denial;
4. Table; or,
5. Defer action to a specified date.

Parking spaces -minimum width is 9 feet for all with the exception of
handicap spaces because they are adjacent to the required handicap access
spaces. Handicap spaces still have a minimum width requirement of 8 ft.
Please change the 3 regular spaces shown on the plan as 8ft., as well as,
General Note #1 to read "all non-handicap spaces are a minimum width of
9ft."

1. Signs will be permitted separately.
2. The irrigation plan will need to be submitted before issuance of a C/O.
3. Please be aware that the UE (Underground Electrical Service Line) will
need to be covered by a PUE (Public Utility Easement) and if the UE
remains in its present location, then a License to Encroach will be
required from Council for the covered walkway to cross the required PUE.
4. The grading plan and detention pond is still being reviewed by staff.
