Please keep in mind that staff's responsibility is to provide the Planning & Zoning Commission with all pertinent facts of a development case, but that staff is not acting as an advocate for the applicants. Therefore, it is in the applicant's best interest to send a representative to the Planning & Zoning Commission meeting to speak on behalf of the proposal. This item is scheduled for the Thursday, May 1, 2003 Planning & Zoning Commission Meeting. This meeting will begin at 7:00 P.M. in City Hall Council Chambers. STAFF REPORT Project Manager: Molly Hitchcock Date: May 1, 2003 Email: mhitchcock@ci.college-station.tx.us Item: Public hearing, discussion, and possible action on a rezoning for Lots 1-6, Block 1 of the Graham Corner Plaza Subdivision from C-2 Commercial-Industrial to C-1 General Commercial. (03-091) Applicant: Ted Whitmer as representative for Graham Corner Development LTD Staff Recommendations: Staff recommends approval of the rezoning. Item Summary: This rezoning is for 10.73 acres located at the southern corner of the Graham Road/HWY 6 frontage road intersection. The applicant began the development of this land last year. His plans for the land include a shopping center with pad sites that would be available for a bank with drive-thru service and a restaurant. C-2 zoning currently allows these uses, but the approved UDO will not allow drive-thrus or restaurants. The applicant is requesting the rezoning to C-1 so the uses will be in compliance with the UDO, which will become effective in June 2003. The property is bound by Graham Road to the north, the frontage road for HWY 6 to the east, dedicated floodway to the south, and undeveloped A-O Agricultural Open to the west. Comprehensive Plan Considerations: The Land Use Plan shows this area to be Regional Retail. The current C-2 zoning of the property, as well as the proposed C-1 zoning, are in conformance with the Land Use Plan. The property has frontage on Highway 6, a Freeway and Expressway on the Thoroughfare Plan, and on Graham Road which is designated as a Major Collector. Item Background: This property was preliminary platted in December 2002 and final platted in March. It is currently in the process of replatting. Commission Action Options: The Commission acts as a recommending body on the question of rezoning, which will be ultimately decided by City Council. The Commission options are: 1. Recommend approval of rezoning as submitted; 2. Recommend a less intense zoning classification; 3. Recommend denial; 4. Table indefinitely; or, 5. Defer action to a specified date.
